AN ORDINANCE CREATING THE JONESBORO ECONOMICAL TRANSPORTATION SYSTEM (J.E.T.S.) (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-06:155 ON FEBRUARY 21, 2006)

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1: There is hereby created the Jonesboro Economical Transportation System (J.E.T.S.).
      
SECTION 2: The Jonesboro Economical Transportation System shall be a division of the Department of Community and Economic Development.  J.E.T.S. will employ a transportation coordinator, under the supervision of the Department of Community and Economic Development, to oversee the daily operations of the transportation system.
 
SECTION 3: Financing for the community transportation system will come from a variety of sources, namely the Federal Transit Administration, Federal Highway Administration, Arkansas Highway and Transportation Department, local businesses, the City of Jonesboro Capital Improvement Fund and local operating subsidies.
 
SECTION 4: J.E.T.S is hereby authorized to draw funds as allocated by the Federal Transit Administration on an 80% federal fund and 20% local match for capital improvement/investment; 50% federal fund and 50% local match for routine operating costs.
 
SECTION 5: Ordinance Number 3506 known as the 2005 City Budget is hereby amended to reflect the following changes:
 
(A)  The sum of $130,000.00 shall be transferred from the unexpended balance of Outside Agencies-Industrial Development (10-130-293-00) to the Outside Agencies- Transit Subsidy (10-130-325-00) as the local match portion of capital investment for new start transportation systems.
 
(B)  The following personnel shall be employed by J.E.T.S.:
1      Transit Coordinator      (Grade 21)      $ 48,695.00
7      Full-Time Captains      (Grade 9)      $ 23,795.36
2      Full-Time Dispatchers      (Grade 8)      $ 21,557.42
1      Accounting Technician      (Grade 10)      $ 23,795.36
1      Clerical      (Grade 7)      $ 20,518.66
1      Janitorial      (Grade 7)      $ 20,518.66
      Part-Time      (As needed)
 
SECTION 6: As previously passed by the Jonesboro City Council on December 1, 2003 and pending the receipt of private contributions, the sum of $130,000.00 shall be appropriated as Transit Subsidy (10-130-325) for each of the first three years of operations; in addition the sum of $130,000 shall be appropriated for an additional two years (2006-2010).
 
SECTION 7: In an effort to evaluate the usefulness of community transportation and to validate its benefit to the community, a vote of "yea" or "nay" by the residents of the City of Jonesboro for the continued support of the community transportation system shall be placed on the ballot of the General Election to be held in November 2008.  If the question of support is rejected by the voters, the city of Jonesboro subsidy would cease no later than December 31, 2010.
 
SECTION 8: All policy and operating functions shall be reported to the Public Services Committee of the Jonesboro City Council, under the direction of the Transportation Subcommittee Chairman.  
 
SECTION 9: A Community Transportation Advisory Board composed of seven citizens shall be formed to provide input, advice and assistance to the Jonesboro Economical Transportation System.  There shall be one board member representing each city ward and one additional member at large. The Mayor, with approval of the Jonesboro City Council, will appoint members to the board.  Each member shall serve a term of no more than three years, with terms to expire at alternating times.  Such board shall have no legislative authority but will function in an advisory capacity.
 
SECTION 10: The Community Transportation Advisory Board, working with the Director of Community and Economic Development, will devise a set of operating policies and procedures, including a comprehensive ADA plan, to present for full council approval and codification into Jonesboro City Code no later than November 1, 2005.   
 
SECTION 11: All ordinances and/or parts of ordinances in conflict herewith are hereby repealed upon approval of this ordinance and its full implementation.
