AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY COMMERCIAL (C-3); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on December 24, 1986; and
WHEREAS, said Petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing upon said Petition was entered, notice was duly published of said hearing and a hearing upon said Petition was duly had and held in the County Court of Craighead County, Arkansas, on January 23, 1987, at which hearing it was duly found and declared that said Petition for Annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an Order of Annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the Order of Annexation dated January 23, 1987, and no proceedings to prevent said annexation have been filed in the City Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its Order of February 23, 1987.
NOW, THEREFORE, BE IT ORDAINED and ENACTED by the City Council for the City of Jonesboro, Arkansas:
Section 1: the territories and land annexed to the City of Jonesboro by Order of the County Court of Craighead County, Arkansas, by its Order of January 23, 1987, be and are hereby accepted by the City of Jonesboro, Arkansas said territory hereinafter described shall be hereafter deemed and taken to be apart and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas, and more particularly described as follows: (Wade Quinn, Hwy 49 N and 351 N / Jim Lyons)
That part of Lots 8, 9 and 10 in Block “F” of F. W. Caldwell’s Subdivision of a part of the Southwest Quarter of the Northwest Quarter of Section 10, Township 14 North, Range 4 East, and that part of the Northwest Quarter of the Southwest Quarter of said Section 10, described as follows: Beginning at the Northeast corner of said Lot 8, run thence North 88˚38’ West 98.5 feet; run thence South 3˚06’ West 324.5 feet to the Northerly right-of-way line of U.S. Highway 49; run thence North 58˚37’ East along said Northerly right-of-way line 218.9 feet; run thence in a Northwesterly direction approximately 220 feet to the point of beginning proper.

That part of Lots 8, 9 and 10 in Block “F” of F.W. Caldwell’s Subdivision of a part of the Southwest Quarter of the Northwest Quarter of Section 10, Township 14 North, Range 4 East, and that part of the Northwest Quarter of the Southwest Quarter of said Section 10, described as follows: Beginning at the Northeast corner of said Lot 8; thence South 88˚38’ East 98.5 feet; thence North 72˚43’ East 157.5 feet to a point of the Westerly right-of-way of line of State Highway 351; thence South 18˚49’ East 56 feet, along the Westerly right-of-way of State Highway 351; thence South 10˚45’ East 73.1 feet to the Northerly right-of-way U.S. Highway 49; thence South 58˚37’ 231.3 feet along the Northerly right-of-way of U.S. Highway 49; thence Northwesterly approximately 220 feet to the point of beginning proper.
Section 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 3 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territories annexed to the City of Jonesboro are hereby zoned Commercial (C-3).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning, water and sewage and other protection and benefit; that said benefits and protections are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist; this Ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force from and after its passage and approval.
