AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS: ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY COMMERCIAL (C-3): DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, Petition for the Annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas on the 6th day of May 1981: and

 

WHEREAS, said Petition for Annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro or by their duly authorized agent; and

 

WHEREAS, an Order setting a hearing upon said Petition was entered, notice was duly published of said hearing and a hearing upon said Petition was duly had and held in the County Court of Craighead County, Arkansas on the 10th day of August, 1981, at which hearing it was duly found and declared that said Petition for Annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas. Whereupon an Order of annexation was made and entered; and

 

WHEREAS, thirty (30) days have expired since the order of annexation dated August 10, 1981 was entered and no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas and said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas by its Order of Confirmation dated October 8, 1981.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territories and land annexed to the City of Jonesboro, Arkansas by Order of the County Court of Craighead County, Arkansas by its Order of August 10, 1981, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall enjoy all the rights and privileges of the inhabitants within the original city limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas, are described as follows:

                     

A part of the South Half Southwest Quarter, Section 27, Township 14 North, Range 4 East. Craighead County, Arkansas and particularly described as follows: Commencing at the Northeast Corner, Southeast Quarter, Southwest Quarter, Section 27, T14N, R4E; thence South along the Section line 530 feet to the centerline Griggs Avenue: thence North 89°28’ West along the centerline Griggs Avenue 1360 feet; thence South 0°32’ West 25 feet to the South right-of-way line Griggs Avenue the point of beginning proper; thence South 1°12’ West 426.72 feet to the North right-of-way line 416.1 feet to the East right-of-way of Missouri Pacific Railroad: thence North 33°35’ East along said right-of-way 461.18 feet to the South line Griggs Avenue; thence South 89°28’ East along South line Griggs Avenue 168.5 feet to the point of beginning proper containing 2.80 acres.

 

A part of the Northeast Quarter of the Northwest Quarter of Section 34; Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Northeast Corner of the Northeast Quarter of the Northwest Quarter of Section 34, Township 14 North, Range, 4 East aforesaid: thence North 89 degrees 19 minutes West along the North line of aforesaid North east Quarter of the Northwest Quarter 405.3 feet; thence South 0°41 West 42.68 feet to the point of beginning proper: thence South 0°41’ West 15.03 feet; thence South 34°41’West 174.0 feet; thence South 0°41’ West 58.0 feet: thence South 53°09’ West 364.0 feet; thence North 89°19’ West 25.0 feet; thence North 1°15’ East 440.7 feet; thence along South right-of-way line Highway #63 By-pass South 89°48’ East 349.17 feet; thence South 82°39’ East 57.85 feet to the point of beginning proper containing 2.65 acres, and being subject in part to existing easement of City Water and Light Plant Outfall Sewer along North Side of the property as noted on the plat.

 

A part of the Northeast Quarter of the Northwest Quarter of section 34, Township 14 North, Range 4 East Craighead County, Arkansas, more particularly described as follows: Commencing at the Northeast Corner of the Northeast Quarter of the Northwest Quarter of Section 34. Township 14 North, Range 4 East aforesaid; thence North 89 degrees 19 minutes West, along the North line of aforesaid North east Quarter of the Northwest Quarter 405.3 feet; thence South 0°41’ West 42.68 feet to the South right-of-way line Highway #63 By-pass; thence along said right-of-way line as follows: North 82°36’ West 57.85 feet South 89°48’ West 500 feet South 87°30’30” West 127.34 feet to the point of beginning proper; thence South 1°15’15’ West 522.35 feet; thence South 89°19’ East 300.0 feet; thence South 0°41’ West 246.28 feet; thence North 89°19’ West 561.8 feet; thence North 1°15’ East 739.1 feet to the South right-of-way #63 By-pass; thence North 81°16’East 138.9 feet: thence North 87°30’30” East 122.8 feet to the point of beginning proper containing 6.36 acres and being subject in part to an existing easement of the City Water & Light Plant Outfall Sewer along North Side Property.

 

A part of the South Half Southwest Quarter, Section 27 (2.67 acres) a part of the Northeast Quarter, Northwest Quarter, Section 34 (l.08 acres), all being in Township 14 North, Range 4, East Craighead County, Arkansas, being that portion of the right-of-way of Highway #63 Bypass lying South of the centerline Highway #63 Bypass between Stations 116 + 92 and 126 + 36.7 more particularly described as follows: Commencing at the Southeast Corner SW ¼, Section 27 aforesaid: thence North 89°19’ West 405.03 feet; thence North 0°12’ West 135.3 feet to the centerline Highway #63 Bypass; the point of beginning proper; thence South 0°12’ East 135.3 feet; thence 0°41’ West 42.68 feet to the South right-of-way line Highway #63 Bypass; thence along said right-of-way line as follows: North 82°36’ West 57.85 feet; South 89°48’West 500.0 feet. South 87°30’30” West 250.14 feet; South 81°16’ West 138.9 feet; thence North 0°12’ West 200.65 feet to the centerline Highway #63 Bypass; thence North 89°48’ East along said centerline 944.7 feet to the point of beginning proper, containing 3.75 acres. Subject in part, to an existing Easement of City Water & Light Plant Outfall sewer along North Side of property.

 

A part of the South Half Southwest Quarter, Section 27, Township 14 North, Range 4 East, Craighead County, Arkansas, being that portion of the right-of-way of Highway #63 Bypass lying North of the centerline of Highway #63 Bypass between Stations 126 + 33 and 130 + 46.6 more particularly described as follows: Commencing at the Southeast Corner SW ¼. Section 27, aforesaid: thence North 89°19’ West 405.3 feet; thence North 0°12’West 135.3 feet to the centerline Highway #63 Bypass: thence South 89.°48’ West along the centerline Highway #63 Bypass 944.7 feet to the point of beginning proper; thence South 89°48’ West along said centerline 413.6 feet: thence North 0°12’ West 255.0 feet to the inter-section of the North right-of-way line Highway #63 Bypass and the Easterly right-of-way of Missouri-Pacific Railroad: thence South 83°56’ East along the North right-of-way line Highway #63 Bypass 416.1 feet; thence South 0°12’ East 209.7 feet to the point of beginning proper containing 2.21 acres.

 

A part of the Northeast Quarter of the Northwest Quarter of  Section 34, Town-ship 14 North, Range 4, East, Craighead County Arkansas and being more particularly described as follows: Commencing at the Northeast corner of aforesaid Northeast Quarter of the Northwest Quarter of Section 34, Township 14 North, Range 4 East: thence North 89 degrees 19 minutes West along the North line of aforesaid Northeast Quarter of the Northwest Quarter 405.3 feet; thence South 0°41’ West 42.68 feet to the South right-of-way line Highway #63 Bypass; thence along said right-of-way line as follows North 82°36’ West 57.85 feet, South 89°48’ West 500 feet, South 87°30’30” West 127.34 feet to the point of beginning proper; thence along the South right-of-way line Highway #63 Bypass, as follows: North 87°30’30” East 127.3 feet, North 89°48’ East 150.83 feet; thence South 1°15’ West 531.74 feet; thence North 89°19 West 275.00 feet; thence North 1°15’ East 522.35 feet to the point of beginning proper containing 3.36 acres. Subject in part, to an existing Easement of City Water & Light Plant Outfall Sewer along South Side of Property.

 

Section 3: The lands and territories annexed to the City of Jonesboro, Arkansas, are hereby accepted by the City of Jonesboro and are hereby assigned and attached to Ward 6 of the City of Jonesboro, Arkansas.

 

Section 4: Said lands and territories annexed to the City of Jonesboro, Arkansas, are hereby zoned Commercial (C-3).

 

Section 5: It is hereby found and declared by the City Council for the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitles to fire, police, zoning, water and sewage and other protection and benefits; that said benefits and protections are urgently needed now in order to allow orderly growth and development of said lands and territory.

 

Therefore, an emergency is hereby declared to exist, this Ordinance being necessary for the preservation of public peace, health and safety and same shall take effect and be in full force and effect from and after its passage and approval.
