AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described, was duly filed in the County Court of Craighead County, Arkansas on July 19, 1983; and

 

WHEREAS, said Petition the annexation of said lands was duly signed by the sole owner of all of the acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, an Order setting a hearing upon said Petition was entered, notice was duly published of said hearing and a hearing upon said Petition was duly had and held in the County Court of Craighead County, Arkansas on August 22, 1983, at which hearing it was duly found and declared that said Petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas whereupon an Order of Annexation was made and entered; and

 

WHEREAS, more than thirty (30) days have expired since the Order for Annexation dated August 22, 1983, and no proceedings to prevent said annexation have been filed in the Circuit Court, for the Jonesboro District of Craighead County, Arkansas, by its Order of December 1st, 1983.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territories and lands annexed to the City of Jonesboro by Order of the County Court of Craighead County, Arkansas by its Order of August 22, 1983, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing herein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas are more particularly described as follows:

 

A part of the Northwest Quarter of the Northeast Quarter of Section 26, Township 14 North, Range 3 East, more particularly described as follows: Begin at the Southeast corner of the Northwest Quarter of the Northeast Quarter of said Section 26; thence North 1°14’ East 30 feet to the South right-of-way line of Wood Springs Road; thence Northwesterly along the South line of said road 210 feet; thence South 110 feet; thence North 89°40’ East 190 feet to the point of beginning proper.

 

Section 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward Four (4) of the City of Jonesboro, Arkansas.

 

Section 4: Said lands and territories annexed to the City of Jonesboro are hereby zoned Residential (R-1).

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to the accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police zoning, water an sewage and other protection and benefit; that said benefits and protections are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist, this ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force from and after its passage and approval.

 

PASSED and ADOPTED this 19th day of December, 1983.
