AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 4, ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1), DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas on July 30, 1986; and
WHEREAS, said petition for the annexation of said land was duly signed by all of the owners of all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on September 3, 1986, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the city of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated September 3, 1986, and no proceedings to prevent said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of April 8, 1987.
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by an order of the County Court of Craighead County, Arkansas, by its order of September 3, 1986, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the city of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit: (Annexation James McDaniel & others, Cove at end of Park hill Blvd., off W. Neely/Mike Gott)
Part of the Southeast Quarter of the Southeast Quarter of Section 27, Township 14 North, Range 3 East, being more particularly described as follows: Begin at the Southeast Corner of Section 27, Township 14 North, Range 3 East; thence West on the Section Line 967.0 feet to the centerline of Arkansas State Highway No.226; thence North 12˚ 26’ West on the centerline of said Highway 462.3 feet; thence North 16˚59’ East on the centerline of said Highway 265.4 feet; thence North 49˚ 09’ East on the centerline of said Highway 348.3 feet; thence North 45˚26’ East on the centerline of said Highway 3094 feet; thence North 65˚37’ East on the centerline of said Highway 212.6 feet to the centerline of a Ditch; thence South 24˚01’ East on the centerline of said Ditch 155.9 feet; thence South 32˚ 09’ West on the centerline of said Ditch 153.0 feet; thence South 6˚34’ East on the centerline of said Ditch 173.0 feet; thence South 64˚53’ East on the centerline of said Ditch 70.0 feet; thence South 3˚50’ West on the centerline of said Ditch 63.0 feet; thence South 32˚56’ East on the centerline of said Ditch 111.0 feet; thence South 55˚02’ East on the centerline of said Ditch 112.0 feet; thence South 5˚03’ West on the centerline of said Ditch 100.0 feet; thence South 16˚21’ East on the centerline of said Ditch 1356.0 feet; thence South 40˚59’ East on the centerline of said Ditch 109.0 feet to the East Line of aforesaid Section 27; thence South 1˚45’ West on the Section line 225.0 feet to the point of beginning, containing 19.9 acres.
The above described tract is subject to Public Road right-of-way off the South Side, West side and Northwest side and a Ditch on the East side.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 4 of the city of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-2).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage.
PASSED and ADOPTED this 4thday of May, 1987.
