AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described, was duly filed in the County Court of Craighead County, Arkansas on March 31, 1986; and
WHEREAS, said petition for the annexation of said lands was duly sought by the owner of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting the hearing upon said petition was entered and notice was duly published of said hearing, and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on May 27, 1986, at which hearing it was duly found and declared that said petition for annexation was right and proper, and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, more than thirty (30) days having expired since the order of the annexation dated May 30, 1986, and no proceedings to prevent said annexation having been filed in the Circuit Court of the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead, Arkansas, by its order of August _____, 1986.
NOW THEREFORE BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of May 30, 1986, are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit: (Annexation - Prospect Baptist Church, Rt.8 Hwy 49N - Keith Blackman)
TRACT 1: A part of NW ¼ of NE ¼ of Section 10, T14N, R4E, Craighead County, Arkansas; being more particularly described as follows: Commencing at the NW corner of NW ¼ of NE ¼ of Section 10, aforesaid; thence S 1247.2 ft. on the section line to the N right-of-way line of state highway #49; thence N57°55' E 582.2 ft. along said right-of-way line to point of beginning proper; thence N 57°55' E 207.2 ft. along said right-of-way line; thence N 32°05' W 410.0 ft.; thence S 57°55' W 327.2 ft.; thence S 32°05' E 200.0 ft.; thence N 57°55' E 120.0 ft.; thence S 32°05' 210.0 ft. to the point of beginning proper and containing, in all, 250 acres, more or less.
TRACT 2: Beginning at NW corner NW ¼ of NE ¼ of Section 10, T14N, R4E; thence S on sec. line 1245.8' to N right-of-way line of State Highway #1 thence N57°59' E along aforesaid right-of-way line 462.2' to the point of beginning proper; thence N 32°01' W at right angles to right-of-way line 210'; thence N 57°59' E 120'; thence S32°01' E 210' to N right-of-way line of State Highway #1; thence S 57°59' W along aforesaid right-of-way line 20'; thence N 32°01' W 150'; thence S 57°59' W80'; thence S 32°01' E 150' to N right-of-way line of State Highway #1; thence S 57°59' W along aforesaid right-of-way line 20' to point of beginning proper, being part of NW ¼ of NE ¼ of Section 10, T14N, R4E.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Jonesboro Township #8 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-1).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said property in said territory described herein can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is herby declared to exist and this ordinance being necessary for the preservation of public peace, health and safety, shall take effect and be in full force from and after its passage.
