I.                     CALL TO ORDER

II.                     ROLL CALL

III.                     APPROVAL OF MINUTES

                     A.                     Minutes for the Stormwater Management Board meeting on July 26, 2007.

Gene Vance requested one change to the minutes on page 2, paragraph 3, to reflect state regulations for a Notice of Intent, which are based on acreage.  With this change, motion to approve the minutes was made by Don Culpepper.  Seconded by Jon Wilbanks.  Unanimously approved.

IV.                     NEW BUSINESS

A.                     Elect Vice Chairperson for the Board.

Farmer stated that he thought Jerry Farris would be willing to serve.  Don Culpepper nominated Gene Vance as Vice Chairperson.  No other nominations were made.  Dewaine Beisner made the motion to appoint Vance.  Culpepper seconded the motion.  It was unanimously approved that Gene Vance be elected Vice Chairperson.

B.                     Best Management Practices Manual.

Farmer stated that two separate manuals existed and it was their goal to merge them into one.  This manual would be a reference for developers.  Farmer has spoken with Kelly Panneck about the best ways to amend the manual.  One member suggested a one page document for developers to keep up with.  Farmer wants to give staff direction to begin this process.  Vance made a motion to instruct the staff to begin the revisions. Farmer seconded.  Motion was unanimously approved.

V.                     PENDING ITEMS

A.                     Internal Operating Rules and Regulations with comments.

Comments on the Rules and Regulations were received by Craig Light and Michael Daniels.  Farmer instructed the board to review the attached comments.  The board and staff discussed at great length the comments reflected on pages 1 and 2 of the Rules and Regulations.

Craig Light had various comments related to conflicts between the City’s Ordinances and the Rules and Regulations.  Those conflicts were discussed and it was decided by the Board that section 7.4 of the Stormwater Management/Drainage Ordinance  (No. 3641) would need to be amended.  The Board agreed that any appeals should be heard during the regularly monthly meeting time.  The Board and staff agreed that appellants need to provide all requested documentation to the Secretary seven (7) business days prior to the regular scheduled meeting.  Notice should be published one time in the local paper prior to the meeting and the appellant is responsible for the publication fee.  The volume of information sent to members needs to be decided.  The Board suggested that the particular items listed in the Rules and Regulations be the only items sent to them, then any additional exhibits or drawing should be presented at the appeal hearing.  Daniels stated that these issues are visual issues and it would be hard to provide only documents without the drawings attached.  John Street suggested that the items be sent to the City Clerk and placed on the City’s website for viewing.

The Board and staff agreed to delete all of paragraph 8, page 2, of the Rules and Regulations.  If there are no appeals, variance requests, or other business pending for the Board to consider at a monthly meeting, then efforts should be made to organize an educational session on drainage.

Farmer stated that it would not be possible to review and discuss all comments during the current meeting.  He suggested the Board and staff have a work session following the next Board meeting.  All parties agreed.  The next meeting will take place from 8:30 a.m. to 11:30 a.m.

B.                     Appeal Hearing Protocol Procedures.

This matter was tabled until the next Board meeting where there will be a work session to discuss comments.

C.                     Discuss Stormwater Drainage Design Manual.

This matter was tabled until the next Board meeting.

D.                     Discuss meeting time and date as it relates to new information regarding Legistar processing and deadlines.

Staff members explained to the Board the deadlines for approval and entering items into Legistar.  It is necessary to move the monthly meeting date in order to have things entered in Legistar in a timely manner before the scheduled Public Works Committee and City Council meetings.  Vance suggested the meeting be moved to the third (3rd) Wednesday of each month.  The Board decided to keep the same meeting time.  It was also restated that the work session will take place at the next meeting.  Therefore the meeting on Wednesday, September 19, 2007, will take place from 8:30 a.m. to 11:30 a.m.
