RESOLUTION TO CONDEMN LOT NO. 12 OF BLOCK H, AND THE WEST 20 FEET OF LOT NO. 1 OF BLOCK H, OF THE ORIGINAL SURVEY OF THE CITY OF JONESBORO, ARKANSAS, FOR THE ESTABLISHMENT OF PUBLIC OFF-STREET PARKING FACILITIES AND TO PAY THE PROPERTY OWNERS $12,825.00 FOR LOT 12 AND $8,550.00 FOR THE WEST 20 FEET OF LOT NO. 1

WHEREAS, the City Council hereby determines and declares that excessive curb parking upon the streets within the City of Jonesboro, Arkansas, and the lack of adequate off-street parking facilities create congestion, obstruct the free circulation of traffic, diminish property values, and endangers the health, safety and welfare of the public; and
WHEREAS, the provision of conveniently located off-street parking facilities are therefore necessary to alleviate such conditions; and that the establishment of public off-street automobile parking facilities are deemed to be a proper public and municipal governmental purpose; and that the acquiring of such parking facilities are necessary to the general public welfare; and
WHEREAS, the General Assembly of the State of Arkansas did pass and adopt Act No.468 of 1949, as amended, providing for the creation of a Municipal Parking Authority for the purpose of providing for the planning, designing, location, financing, acquisition of property for construction, maintenance, operation and fostering of off-street parking facilities; and
WHEREAS, the City council of the City of Jonesboro, Arkansas, pursuant to the laws of the State of Arkansas did on the 8th day of August, 1952 adopt Ordinance No.840 creating the Municipal Parking Authority of the City of Jonesboro, and
WHEREAS, the City Council does hereby find a necessity for acquiring additional off-street parking facilities, and that the acquiring of Lot NO.12 Bock H, and the West 20 feet of Lot 1, Block H, of the original survey of the City of Jonesboro, Arkansas is necessary for use by the public for such purposes; and
WHEREAS, the above described property has been duly appraised by a professional licensed appraisal firm and its fair market value as of this date fixed at the sum of $12,825.00 for Lot No.12, and at $8,550.00 for the West 20 feet of Lot No.1, aforesaid, for a total fair market value of $21,375.00; and
WHEREAS, the City of Jonesboro has made a bona fide offer in good faith to the record title owners of said land of a sum within the reasonable limits of the appraised fair market value of said property, and that the owners of said land have for a period in excess of two years failed, refused and neglected to name a price or negotiate a purchase price for said property, and that condemnation of said property for public use is made necessary because the City and the owners of the foregoing described property have been unable to negotiate and agree upon a fir price for said property.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas sitting in regularly assembled session this 7th day of December 1959, that the City of Jonesboro in co-operation with the Municipal Parking Authority of the City of Jonesboro be and are hereby authorized and directed to condemn for public use the following described property in the City of Jonesboro, to-wit:
Lot No.12 of Block H, and the West 20 feet of Lot No.1 of Block H, of the original survey of the City of Jonesboro, Arkansas
BE IT FURTHER RESOLVED, that the City Attorney and such other City officials and officers as are necessary or required be and are hereby authorized and directed to immediately prepare, file and prosecute condemnation proceedings to acquire title and possession to the above described property for public use as herein stated.
