BE IT ORDAINED by the City Council of Jonesboro, Arkansas:

 

SECTION 1: Ordinance No. 954 known as the zoning ordinance of the City of Jonesboro, Arkansas, be amended as recommended by the Metropolitan Area Planning Commission by the changes in zoning classifications as follows:

 

From Residential (R-1) to Commercial (C-3) the following described property:

 

LEGAL DESCRIPTION:

 

TRACT 1

A part of the Southeast Quarter of the Southeast Quarter of Section 15, Township 14 North, Range 3 east, Craighead County, Arkansas, being more particularly described as follows: Begin at the Northeast corner of the Southeast Quarter of the Southeast Quarter of Section 15, Township 14 North, Range 3 east, Craighead County, Arkansas, thence south 0°41'00" West along the east line of the Southeast Quarter of the Southeast Quarter of Section 15, aforesaid, 364.95 feet to the Northerly Right-of-way line of West Washington Avenue; thence along said right-of-way line as follows: along a 6.82966' curve to the left with a radius of 839.00 feet, a distance of 334.45 feet, South 39°05'00" West 6.70 feet, along a 8.3158' curve to the right , with a radius of 689.00 feet, a distance of 266.40 feet to the easterly right-of-way line of United States Highway #63; thence along said right-of-way line as follows:  North 13°03'14" West 18.10 feet, South 60°22'00" West 93.00 feet, North 14°44'00" West 486.10 feet, North 46°22'00" West 215.05 feet to the North line of the Southeast Quarter of the Southeast Quarter of Section 15, aforesaid; Thence North 88°59'06" East along said North line 646.28 feet to the point of beginning proper, containing 5.52 acres.  And

A part of the Southeast Quarter of the Southeast Quarter of Section 15, Township 14 North, Range 3 east, Craighead County, Arkansas, being more particularly described as follows: Begin at the Southeast corner of the Southeast Quarter of the Southeast Quarter of Section 15, Township 14 North, Range 3 east, Craighead County, Arkansas, thence south 88°56'39" West along the south line of the Southeast Quarter of the Southeast Quarter of Section 15, aforesaid, 352.26 feet to the Easterly right-of way line of United States Highway #63; thence along said right-of-way line as follows: North 15°55'00" West 291.90 feet, North 7°41'00" East 82.50 feet, North 42°18'00" East 286.20 feet to the southerly right-of-way line of west Washington Ave; thence along right-of-way line as follows: Along a 8.1392' curve to the right, with a radius of 704.00 feet, a distance of 67.20 feet, North 51°24'53" East 91.90 feet, North 55°57'00" East 39.79 feet to the East line of the southeast quarter of the southeast quarter of Section 15, aforesaid; thence south 0°41'00" West along said East line 791.79 feet to the Point of Beginning proper, containing 5.58 acres.

 

SECTION 2: It is found and declared by the City Council that the proper use of the tract(s) of land described above in this ordinance is being delayed because of improper zoning, and that, therefore, an emergency is hereby declared to exist and this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage and approval.
