WHEREAS, the City of Jonesboro has heretofore acquired acreage on which an Airport has been constructed, has appointed an Airport Commission to manage same pursuant to law, and said Commission, by formal Resolution, and the City Council of Jonesboro finds that certain of the property so acquired is unnecessary for airport uses and that the proceeds of sale of same is necessary to the proper improvement and maintenance of the Municipal Airport of Jonesboro, and the use of the portion of the premises proposed to be sold will be in the public interest and add to the private and public economy of the City,
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1: That the City Council finds that the following described real estate is surplus and not required in the operation or use of the Jonesboro Municipal Airport, and that it is in the public interest to sell same for a consideration of $1,000.00 the track concerned being described as:
 
Begin at Quarter Corner of Sections 21 and 22, Township 14 North, Range 4 East, thence South on Quarter Section Line 150.5 feet to St. Louis-San Francisco Railway Company right-of-way line, thence North 44 degrees 08 minutes West along said right-of-way line 917.2 feet, thence North 46 degrees 49 minutes East 659.1 feet, thence North 42 degrees 27 minutes West 1782 feet, to the southerly right-of-way line of the St. Louis Southwestern Railway Company to the point of beginning proper, thence South 42 degrees 27 minutes East 1782 feet, thence South 46 degrees 49 minutes West 659.1 feet to the easterly right-of-way line of the St. Louis San Francisco Railway Company, thence North 44 degrees 08 minutes West 1382.1 feet along said right-of-way line, thence North 0 degrees 05 minutes East 769.5 feet to the southerly right-of-way line of St. Louis Southwestern Railway Company, thence South 88 degrees 55 minutes East Approximately 234.9 feet to the point of beginning proper, containing 26.5 acres, more or less.
 
Reserving an easement for Lead track that may be constructed by St. Louis Southwestern Railway Company at Railway's cost, not exceeding 20 feet in width along the northeasterly side of the tract.
 
SECTION 2: the Chairman and Secretary of the Airport Commission of Jonesboro, Arkansas, and the Mayor and the City Clerk are authorized and directed to execute a good and sufficient Warranty Deed to the premises described in Section 1 upon payment of the consideration stated in said Section, and to execute options and contracts to convey same to the Jonesboro Industrial Development Corporation or such other persons or corporations as shall be designated by said Development Corporation.
 
SECTION 3: It is ascertained and declared that the lands involved in the foregoing Resolution, not being required by the City, but, on the contrary, being a drain upon the public revenues for the upkeep of same, constitute a detriment to the City of Jonesboro and the citizens thereof, and the proposed use of the premises after sale will be conductive to the public welfare and afford needed revenues for the upkeep and improvement of the municipal Airport, and the prompt accomplishment of the contracts of sale and conveyance approved herein being necessary to the protection of the public peace, health, and safety, an emergency is declared to exist, and this Resolution shall take effect and be in force from and after its passage.
 
PASSED and ADOPTED this 19th day of October, 1959.
