ORDINANCE ADOPTING THE JONESBORO PROPERTY MAINTENANCE CODE BY REFERENCE AMENDING ARTICLE 1, CHAPTER 105, BUILDINGS AND BUILDING REGULATIONS, CREATING SECTION 105-2, JONESBORO PROPERTY MAINTENANCE CODE FOR THE PURPOSE OF PRESERVING PROPERTY, BUILDINGS, AND STRUCTURES FOR THE PRESERVATION OF PUBLIC PEACE, HEALTH AND SAFETY WITHIN THE CITY LIMITS OF JONESBORO, AR

Body

WHEREAS, the City of Jonesboro seeks to create the Jonesboro Property Maintenance Code, regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use.

 

WHEREAS, on July 7, 2015, the City Council appointed a Property Maintenance Code Committee for the charge of reviewing the 2012 International Property Maintenance Code and evaluate its provisions for governing the conditions and maintenance of all property, buildings and structures with the city limits of Jonesboro, AR; and

 

WHEREAS, the Property Maintenance Code Committee met over a period of 14 weeks in open committee work sessions reviewing said Code document and voted to forward a complete recommendation to the City Council for adoption; and 

 

WHEREAS, the Public Safety committee has addressed all public comments received and has approved said technical code and forwarded said code to City Council for adoption; and

 

WHEREAS, pursuant to ACA 14-55-207, public notice was given of the City's intent to adopt said technical code by reference, advertised that three (3) copies of the document were on file and available for public review and examination in the Office of City Clerk.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS, THAT:

 

Section 1. That the Jonesboro Property Maintenance Code is hereby adopted by reference by the City of Jonesboro, Arkansas and said code shall be included in the Jonesboro City Code of Ordinances.

 

Section 2. That if any section, subsection, sentence, clause or phrase of this legislation is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance.

 

Section 3. That nothing in this legislation or in the Jonesboro Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this law; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this legislation.

 

Section 4. That the City Clerk is hereby ordered and directed to cause this legislation to be published as required by law.
