AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT DATED FEBRUARY 24, 1987, PROVIDING FOR A ZONING CLASSIFICATION FOR SAID LANDS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 5 AND FOR OTHER PURPOSES

WHEREAS, an amended petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed with the Clerk of the County Court of Craighead, Arkansas, at Jonesboro, Arkansas, on the 16tj day of January, 1987, and,
WHEREAS, said amended petition for the annexation of said lands was signed by all of the owners of the acreage to be annexed to the City of Jonesboro, Arkansas; and,
WHEREAS. An order setting a hearing on said amended petition was entered, notice was duly published of said hearing, and hearing upon said amended petition was duly had and held in the County Court on the 24th day of February, 1987, at which hearing was duly fond and declared that said amended petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and,
WHEREAS, thirty days have expired since the order of annexation dated February 24, 1987, was entered and no proceedings to prevent said annexation have been filed in the Circuit Court of the Jonesboro District of Craighead County, Arkansas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the City of Jonesboro:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas by order of the County Court for the Jonesboro District of Craighead County, Arkansas, dated February 24, 1987, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereafter be deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and residents residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Annexation - Red Carpet Inn on corner of Apache and Stadium, Raymond Roberts, Paul Hopper, Attorney)
A part of the Southwest Quarter of the Southeast Quarter of Section 28 Township 14 North, Range 4 East, being more particularly described as follows: Commencing at the Northeast Corner of said Southwest Quarter of the Southeast Quarter and run South 89˚57’ West along the 40 acre line 1012.1 feet to the point of beginning proper; thence South 89˚57’ West 240 feet; thence South 0˚42’ West 336.6 feet; thence North 89˚52’ East 340 feet; thence North 0˚42’ East 236.3 feet; thence South 89˚57’ West 100 feet; thence North 0˚42’ East 100 feet to the point of beginning proper, subject to easement along the South side thereof.
Section 3: The zoning classification of the lands so annexed shall be designated as “C-3.”
Section 4: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City are assigned and attached to Ward 5 of the said City of Jonesboro.
