AN ORDINANCE TO AMEND TITLE 8, CHAPTER 8.40, OF THE JONESBORO CODE OF ORDINANCES, BY ADDING SECTIONS 8.40.23 “PARKING IN FIRE LANES PROHIBITED”, 8.40.24 “REQUIREMENTS FOR FIRE LANE MARKINGS”, AND 8.40.25 “PENALTY FOR EACH VIOLATION COMMITTED”

WHEREAS, The City Council of the City of Jonesboro, Arkansas adopted the Arkansas Fire Prevention Code, giving the Fire Official power and authority to direct such operation as may be necessary to extinguish or control any fire, and;
WHEREAS, the Arkansas Fire Prevention Code, Chapter Six, known as Fire Controls, authorizes the Fire Official to require designated fire lanes deemed necessary for fire department access. The required width of access shall not be obstructed in any manner, including the parking of vehicles. Installation of "NO PARKING" signs, inhibiting parking, may be required and if installed shall be maintained. The owner or his representative of a building which is adjacent to the fire lane shall be responsible for keeping the fire lane free of obstructions. (Ark. Fire Code, Section 602.6).
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that Title 8, Chapter 8.40, of the Jonesboro Code of Ordinances be amended as follows:
SECTION 1:
(A) Add Section 8.40.23, PARKING IN FIRE LANES PROHIBITED. It shall be unlawful for any person, unless duly authorized, or a public officer acting within the scope of their public duties, to park in a designated fire lane.
(B) Add Section 8.40.24, REQUIREMENTS FOR FIRE LANE MARKINGS.
All designated fire lane markings must be done in florescent red paint and a sign shall be posted stating the following:
FIRE LANE
"No Parking"
Minimum $50.00 Fine
(C) Add Section 8.40.25, PENALTY FOR VIOLATION; RESPONSIBILITY OF OWNER. Any person violating any of the terms of Section 8.40.23 and/or Section 8.40.24 shall be guilty of a misdemeanor and subject to a fine of not less than Fifty Dollars ($50.00) for each offence. In addition to the Fifty Dollar ($50.00) penalty, when any vehicle is found illegally parked as provided in Section 8.40.23, the Fire Official is authorized to contact a wrecker service for the purpose of towing such vehicle away. The wrecker may tow the vehicle to the place of business of the owner of the wrecker. Responsibility for any such violation shall rest with the owner of any vehicle illegally parked, regardless of who actually placed the vehicle in the parking area.
SECTION 2: It is found and declared by the City Council of the City of Jonesboro, Arkansas that this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its' passage and approval.
