AN ORDINANCE ACCEPTING A PART OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 17, TOWNSHIP 14 NORTH, RANGE 4 EAST TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED OCTOBER 13, 1974; ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, Western District, on September 13, 1974; and
WHEREAS, said petition for the annexation of said land was signed by all of the real estate owners, owning all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing, and a haring upon said petition was duly had and held in the County Court on October 13, 1974, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, whereupon an Order of Annexation was made and entered; and
WHEREAS, 30 days has expired since the Order of Annexation dated October 15, 1974, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Western District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court by its order of December 16, 1974.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, Western District, by its order of October 15, 1974, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein, shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to the City and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
A parcel of land in the Jonesboro District of Craighead County, Arkansas, being a part of the NE ¼ NE ¼ of Section 17, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the North ¼ corner of said Section 17; thence East on the Section 1430.6’; thence S 1° 28’ W 396.6’ thence S 89°55’ E 549.2’; thence S 1°28’ W 66’ to the point of beginning proper; thence S 89° 55’ E 629.3’ to the West right-of-way line of Caraway Road; thence S 1°30’ W along said right-of-way line 259.65’; thence S 89°48’ W 630’; thence N 1° 37’ E 262.8’ to the point of beginning proper, consisting of 3.8 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 3, of the City of Jonesboro, Arkansas.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is not an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro so that said property may be included in the City’s next census court; and that it is in the interest of the City of Jonesboro and the citizens and property owners of said territory that same be annexed to the City so that the said territory that is set out above can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
