AN ORDINANCE TO MAKE IT UNLAWFUL FOR ANY PERSON, FIRM OR CORPORATION TO THROW, PLACE, OR OTHERWISE DEPOSIT ANY PAPER, CANS, BOTTLES, OR OTHER TRASH, REFUSE OF GARBAGE UPON ANY OF THE STREETS OF THE CITY OF JONESBORO, ARKANSAS; OR TO DRIVE OR OPERATE ANY VEHICLE UPON SAID STREETS UNLESS SUCH VEHICLE IS SO CONSTRUCTED OR LOADED AS TO PREVENT ANY PART OF ITS LOAD FROM DROPPING, SHIFTING, LEAKING OR OTHERWISE ESCAPING FROM SAID VEHICLE AND ONTO THE STREETS IN THE CITY OF JONESBORO; TO PROVIDE PENALTY FOR VIOLATIONS HEREOF; AND FOR OTHER PURPOSES

BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro. Arkansas:
SECTION 1: Hereafter it shall be unlawful for any person, firm or corporation to throw, place or otherwise deposit any paper, cans, bottles or other trash, refuse or garbage upon the streets in the City of Jonesboro, Arkansas.
SECTION 2: Hereafter it shall be unlawful for any person, firm or corporation to drive or operate any vehicle of any kind or character upon any of the streets in the City of Jonesboro, Arkansas unless such vehicle is so constructed or loaded as to prevent any part of it’s load from dropping, shifting, leaking, spilling or otherwise escaping from said vehicle and onto the streets of the City of Jonesboro, Arkansas.
SECTION 3: A Writ of Attachment may be issued against any vehicle used in violating the provisions of this Ordinance for the collection of any fine assessed for such violation.
SECTION 4: Any person, firm or corporation driving or operating any vehicle upon any of the streets in the City of Jonesboro, Arkansas shall be liable for all damages which said streets or structures may sustain as a result of a violation of this ordinance.
SECTION 5: Any person, firm or corporation violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction shall be fined in any sum not less than $10.00 nor more than $100.00, and in addition thereto may be assessed and ordered to pay all damages which said street or structure may have sustained by reason of a violation of this ordinance.
SECTION 6: It is hereby found and determined by the City Council that many gravel and ready-mix concrete trucks are being loaded and driven over the streets of Jonesboro in such a manner that the gravel and concrete is spilling from said trucks onto the cities streets, and that same creates and constitutes a hazard to the raveling public and also is damaging the street surface; that numerous other trucks or vehicles are being loaded and driven over the streets of Jonesboro in such a manner as to spill or strow scrap building material and other objects upon said streets thereby constituting a hazard and damaging the cities streets, and that if such practice is not immediately stopped the City of Jonesboro will and has suffered considerable damage and will be forced to expend great sums of money for the repair and maintenance of said streets because of such damage, and that such practice has and will continue to endanger public life and property if it is not immediately stopped; therefore, an emergency is hereby declared to exist and this Ordinance being necessary for the immediate preservation and protection of the public peace, health and safety, will be in full force and effect from and after it’s passage and adoption.
