ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS

WHEREAS, the following described lands are currently zoned “R-1” residential use classification:
Part of the NE 1/4 of the SE 1/4 of Section 20, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Center of aforesaid Section 20; thence N89°32'E on the 1/4 section line 1511.42'; thence S0°16'35"W 13.2' to the South R/W line of Nettleton Avenue, the point of beginning proper; thence N89°18'47"E along said R/W line 128.10'; thence with the meanderings with an existing fence and fence line produced northward as follows: S0°22'46"E-160.65'; S1°28'37"W-25.52; S0°24'34"E 121.43'; S89°21'27"W-130.86'; N0°16'35"E 307.52' to the point of beginning proper,
Subject to all easements and Rights Of Way of record;
WHEREAS, the above described lands are owned by Berl A. Smith, individually and as Trustee of the Berl S. Smith Testamentary Trust; and
WHEREAS, the Jonesboro Metropolitan Area Planning Commission has recommended that said lands be rezoned to C-3 commercial use classification; and
WHEREAS, it appears to the City Council that all applicable laws of the State of Arkansas and of the City of Jonesboro have been complied with in presenting this ordinance to the City Council.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The Zoning Ordinance of the City of Jonesboro, Arkansas, codified as Title 14 of the Jonesboro Municipal Code, should be, and it hereby is amended so that the lands hereinabove described are zoned C-3 commercial use classification.
SECTION 2: All ordinances and parts of ordinances in conflict herewith are hereby repealed.
SECTION 3: The City Clerk is hereby directed to amend the official zoning district boundary map of the City of Jonesboro, Arkansas, insofar as it relates to the lands described hereinabove so that the zoning classification of said lands shall be in accordance with the provisions of this Ordinance.
