•                     Sandra Lane in the northeast corner at the intersection with Stephanie Lane.

•                     Sandra Lane in the southwest corner at the intersection with Sandra Cove/Sandra Lane.

All voted aye.

PARKING - PROPERTY AT MAIN AND BURKE

Councilman Province presented information regarding a request by Ms. Nancy Chrisman on behalf of the Downtown Association requesting a parking lot at Main and Burke Street.  The proposal was to pay Mr. Jerry Halsey $25,000 for the purchase of additional land located near property already owned by the City of Jonesboro, then let lease him a place for his advertising sign for $1.00.  The question was asked if a parking lot could not be created without moving Mr. Halsey’s sign.  It was explained that public parking could be created without the Halsey property by using Cate Street as the ingress location.  Mayor Brodell was asked to do a title search, get a legal description in preparation of a deed before a recommendation could be made.

TOWING CHARGES

Councilman Province explained the Jonesboro Code of Ordinances would have to be amended to clarify who would be responsible for paying towing charges when a vehicle is towed.  It was explained that the City Attorney was reviewing the matter and would make a recommendation.

REQUEST TO LEASE THE CARAWAY/ MATTHEWS FIRE STATION

Councilman Province stated the director of the NEA for Animals has requested the use of the old Caraway/Matthews Fire Station for a four month period.  He explained they wanted to park a mobile unit on the lot which would be used for spading and neutering of animals with the surgeries being preformed in the mobile unit.  Mayor Brodell stated the building is currently being used for storage but stated he had no objections as long as it was kept clean.  Councilman Province stated it needed to be understood that if the property sold it would have to be vacated immediately.  Councilman Province moved, seconded by Councilman Dover to accept Mayor Brodell’s recommendation to lease the property to NEA for Animals.  Mayor Brodell was asked to have the City Attorney to prepare a lease containing all the stipulations (insurance, liability, vacating) and a resolution to be voted on by the full council at the next council meeting.  All voted aye.

PARKING ACROSS FROM FRED’S DEPARTMENT STORE

Councilman Province reported he had been approached by a representative of Union Planter’s Bank about additional parking across from Fred’s Department Store.  He explained they already have parking provided, but the problem is people just do not want to have walked more than ½ block from their job.

SIGNALIZATION AT HIGHWAY 18 AND 351

Councilman Dover moved, seconded by Councilman Province to accept the recommendation to proceed with the necessary steps for signalization at the intersection of Highway 18 and 351.  Mayor Brodell reported it was a 90/10 match which was approved April 15th, 2002 by Resolution No. 2002:18.  He also explained the City currently maintains approximately 75 traffic lights. All voted aye.

SIGNALIZATION AT CORNER OF WASHINGTON AND BRIDGE

Councilman Dover moved, seconded by Councilman Street to accept the Mayor’s recommendation for signalization at the corner of Washington and Bridge Street contingent on if the count is still valid on the study conducted by Mr. Ernie Peters over two years ago.  It was explained the cost would be 85 to 100 thousand dollars and would have to be paid in full by the City of Jonesboro.   Mayor Brodell was asked to research the budget to determine where the funds would come from.  All voted aye.

LANDSCAPING IN FRONT OF MARSHALL ESTATES

Mayor Brodell reported there had been a request for landscaping in front of Marshall Estates with an estimated cost of $25,000.  He stated he would provide information to committee members at a later date.

WALL REPLACEMENT BY THE CITY CEMETERY

Mayor Brodell reported the walls located on the west side of Marshall Estates by St. Bernard’s Hospital would have to be replaced.  He explained the original bid to replace the wall was $22,000 which he considered to be too high.  He also explained this would be an addendum to the existing MATA project.  Mayor Brodell stated they would provide more information at the next committee meeting.

CULVERT AT SOUTH CULBERHOUSE

Mayor Brodell stated a decision would have to be made as to whether or not to go with two or three tiles.  He explained the Highway Department turned the City down on installing three tiles, so it would cost the City $34,000 to have it installed.  Mr. Martin explained the reason the third tile was turned down was because the Highway Department designs strictly on a twenty-five year flood, and he recommended the third tile to prevent water from going over the top of the road which would result in homes flooding.  Councilman Farmer questioned if for $34,000 upstream detention ponds could not be built, and be more cost efficient.  Mr. Martin and Mr. Hooton both stated the cost of land would be a factor, but unimproved land was available.  Discussion followed regarding the provisions of the Storm Water Act and what detention ponds were to be included in the new mall plans.  Mr. Martin and Mr. Hooton were asked to research the matter and report back to the committee.

CHANGE ORDER - EAST MATTHEWS

Councilman Dover moved, seconded by Councilman Province to approve a change order of $12,370 on E. Matthews in the Marshall Estates.  Some how a detention pond was removed from the plans and a house was built instead, causing a need for extensive drainage work.  All voted aye.

WAIVE BIDS - CARTEGRAPH

Councilman Dover moved, seconded by Councilman Street to recommend to the full council an ordinance to waive competitive bidding for work order software from Cartegraph for $20,000.00.  Mr. Alan Young explained the software would be provided to the Mayor’s Office and Public Works and would contain expanded management capabilities.  Councilman Perrin requested a report be provided by Mr. Alan Young regarding the various software installations.  All voted aye.

LINE ITEM TRANSFER

Councilman Dover moved, seconded by Councilman Street for a line item transfer for $500.00 from mowing to fixed assets for the Planning and Inspection budget.  It was explained that Resolution No. 2003:19 allows for line item transfers up to $1,000.00 with Finance Committee approval.  All voted aye.

ORDINANCE - REGARDING SUBDIVISIONS

The committee was waiting on an amendment and recommendation by the City Attorney regarding an ordinance regulating subdivisions and amending Jonesboro Code of Ordinances 15.16.01.

3411 QUAIL RIDGE

Discussion was held regarding how to proceed with plans for a retention pond for the purpose of resolving drainage issues in the immediate area as well as downstream.  Committee members needed clarification regarding the fair market value of the McDaniel property.  It was explained that consideration needed to be given to water damage, as well as the debt owned against the house.  Other considerations, should the McDaniel’s accept the agreed amount for the property was a contract holding the City harmless for any damages.  Councilman Farmer stated he had spoken with Phillip Crego, City Attorney about being able to get restitution from the developer who built the home where the retention pond was to be.   Attorney Crego gave the opinion that the City of Jonesboro would not be in a position to get restitution because they issued the building permit, approved the subdivision, and created the situation.  The decision was made to get the legal description from Bob Gibson for the rest of the property, get the appraisal, and get clarification from the City Attorney in an effort to address the matter at the December 15th city council meeting.

With no further business, Councilman Street moved, seconded by Councilman Dover to adjourn.  All voted aye.
