AN ORDINANCE TO AMEND SECTION 5-8 AND 5-9, AS AMENDED, THE SAME DEALING WITH ADOPTION OF THE BUILDING CODE FOR THE CITY OF JONESBORO, ARKANSAS. (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-95:523 ON AUGUT 7, 1995)

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: That Section 5-8 of the Code of Ordinances of the City of Jonesboro, Arkansas, is hereby amended to read as follows:
There is hereby adopted by the City Council of the City of Jonesboro, Arkansas, a certain building code known as the Standard Building Code, specifically being the 1988 edition. The Standard Building Code, 1988 edition, as adopted, shall establish rules and regulations to provide minimum requirements to safeguard life, health and public welfare and the protection of property as it relates to these safeguards by regulating and controlling the design, construction, alteration, repair, equipment, use and occupancy, location, maintenance, removal and demolition of all buildings or structures and appurtenances thereto within the corporate limits of the City of Jonesboro, Arkansas. There are not less than three copies of the Standard Building Code, 1988 edition, now on file in the Office of the City Clerk of the City of Jonesboro, Arkansas, and the same are hereby adopted and incorporated as set out therein and shall be in full force from the date which this article shall take effect.
SECTION 2: That Section 5-9 of the Code of Ordinances of the City of Jonesboro, Arkansas, is hereby amended to read as follows:
(A) Appendix A through R of the Standard Building Code, 1988 edition, are specifically excluded and are not adopted by this article.
(B) The Board of Adjustments and Appeals as described in Section 105, Standard Building Code, 1988 edition, shall also assume the functions of the Board of Adjustments and Appeals as described in Section 105 of the Standard Mechanical Code, 1988 edition.
(C) The membership of the Board of Adjustments and Appeals shall be seven (7) rather than five (5).
(D) The terms of office of the additional members of the Board of Adjustments and Appeals shall be: One (1) additional member whose terms, when first appointed, shall be two years; One (1) additional member whose term, when first appointed, shall be one (1) year.
(E) The jurisdiction and scope of review of the above Board shall include receiving appeals from decisions of the Electrical and Plumbing Inspector as well as the Building Inspector of the City of Jonesboro.
SECTION 3: It is found and declared by the City Council of the City of Jonesboro, Arkansas, that the above sections need to be amended to adopt the most recent edition of the Standard Building Code and therefore, this ordinance being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
