AN ORDINANCE ABANDONING A PORTION OF LAND LOCATED IN THE CITY OF JONESBORO, ARKANSAS

WHEREAS, the City Council at its regular meeting hearing the request to abandon the Utility Easements described as follows:
LEGAL DESCRIPTION
Easement 1 to be abandoned a 10 foot wide Utility Easement on Lot 1 of the first Replat of West Branch Commercial Addition, Jonesboro, Arkansas, Craighead County, Arkansas, more particularly described as: Commencing at the Northwest Corner of said Lot 1; thence S 0/ 31' 09" W along the West Line of said Lot 1 for 81.90 feet to the point of beginning; thence S 89/ 30' 53" E for 297.02 feet; thence S 0/ 29' 08" W for 24.53 feet; thence N 89/ 28' 54" W for 10.0 feet; thence N 0/ 29' 08" E for 14.52 feet; thence N 89/ 30' 53" W for 287.02 feet to a point on the West Line of said Lot 1; thence N 0/ 31' 09" E along the West Line of said Lot 1 for 10.0 feet to the point of beginning, and containing 3,117 square feet, more or less.

Easement 3 to be abandoned a 15 foot wide Utility Easement on Lot 1 of the first Replat of West Branch Commercial Addition, Jonesboro, Arkansas, Craighead County, Arkansas, more particularly described as: commencing at the Northwest Corner of said Lot 1; thence N 89/ 32' 08" E along the North Line of said Lot 1 for 982.93 feet to the Northwest Corner of Lot 4 of said first Replat of West Branch Commercial Addition; thence S 0/ 31' 06" W along the West Line of said Lot 4 for 128.34 feet; thence S 89/ 28' 54" E along the South Line of said Lot 4 for 24.07 feet to the point of beginning; thence continuing along the South Line of said Lot 4 S 89/ 28' 54" E for 15 feet; thence S 0/ 31' 06" W for 98.20 feet to a point on the North Line of Lot 3 of said first Replat of West Branch Commercial Addition; thence N 89/ 28' 54" W along the North Line of said Lot 3 for 15.0 feet to the Northwest Corner of said Lot 3; thence N 0/ 31' 06" E for 98.20 feet to the point of beginning, containing 1,473 square feet, more or less.

JONESBORO, ARKANSAS, CRAIGHEAD COUNTY, ARKANSAS, more particularly described as:
Commencing at the Southeast Corner of said Lot 2; thence S 89/ 28' 14" W along the South Line of said Lot 2 for 188.52 feet to the Southwest Corner of said Lot 2; thence N 0/ 31' 06" E along the West Line of said Lot 2 for 15.0 feet to the point of beginning; thence continuing along the West Line of said Lot 2 N 0/ 31' 06" E for 218.82 feet to the Northwest Corner of Lot 2; thence S 89/ 28' 54" E along the North Line of said Lot 2 for 109.25 feet; thence N 0/ 31' 06" E for 104.72 feet to the Southwest Corner of Lot 3 of said first Replat of West Branch Commercial Addition; thence S 89/ 28' 54" E along the South Line of said Lot 3 for 15.0 feet; thence S 0/ 31' 06" W for 119.72 feet; thence N 89/ 28' 54" W for 109.25 feet; thence S 0/ 31' 06" W for 203.55 feet; thence S 89/ 28' 14" W for 15 feet to the point of beginning, and containing 6,490 square feet, more or less.
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas, that;
SECTION 1: The City of Jonesboro, Arkansas, hereby vacates and abandons all of its rights together with the right of the public generally, in Jonesboro, Arkansas.
SECTION 2: A copy of this ordinance duly certified by the City Clerk shall be filed in the office of Recorder of Craighead County at Jonesboro, Arkansas, and recorded in the Deed records of Craighead County, Arkansas.
SECTION 3: The closing, vacating and abandonment by the City of its rights and the rights of the public generally in the above described portion of the easement is in the public interest and will promote the public peace and welfare.
