CITY COUNCIL MINUTES - APRIL 4, 1994

 

The Jonesboro City Council met at 6:00 p. m. due to the National Basketball Tournament. Present were the City Clerk, City Attorney, and all council members with the exception of Councilman Province, Councilman Wise and Councilwoman Ingram who were unable to attend. Vice Mayor Hannah presided over the meeting in the absence of Mayor Brodell who was away on official business.

 

The minutes of March 21, 1994, were approved as mailed by motion of Councilman Vance seconded by Councilman Perrin. A roll call vote was taken resulting in all council members voting aye. Those voting aye were: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah.

 

Councilman Harpole read a proclamation (on behalf of Mayor Brodell) declaring April 5, 1994, "ASU Lady Indians Basketball Day" in Jonesboro. The team was runner-up for the National Women's Invitational Tournament championship.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE, PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND OTHER PURPOSES. (KENWARD/NOELL)

 

Councilman Vance moved, seconded by Councilman Harpole for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those voting aye were: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah. The ordinance was given the number 2544.

 

Due to the change in meeting time, the Council agreed to move items "B", "C" and "E" to the bottom of the agenda to allow concerned citizens time to arrive.

 

The following ordinance was on the second reading:

 

AN ORDINANCE TO AMEND TITLE 2.20 ADDING SECTION 2.20.10 TO ESTABLISH PROCEDURES FOR BRINGING ORDINANCES BEFORE THE CITY COUNCIL

 

Councilman Bowers moved, seconded by Councilman Harpole for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those voting aye were: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah. The ordinance was given the number 2547.

 

The following ordinance was tabled:

 

AN ORDINANCE TO PROVIDE A SMOKE FREE ENVIRONMENT FOR ALL MUNICIPAL BUILDINGS

 

Councilman Evans moved, seconded by Councilman Vance to table the ordinance till the next council meeting (April 18, 1994). Discussion followed with Councilman Hannah and Councilman Kelton questioning the delay. Councilman Evans explained the reason for the tabling was due to several council members and quest speakers being absent. A roll call vote was taken resulting in a six to three vote in favor of the motion. Those voting aye were: Evans, Perrin, Kelton, Vance, Harpole and Mays. Those voting nay were: Mullenix, Bowers and Hannah. The third reading was tabled until April 18, 1994.

 

The following bids were reviewed:

 

PS94:01 - Public Sale - 2 Ford Fire Trucks

Councilman Mays moved, seconded by Councilman Harpole to accept the sale to the highest bidder. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were as follows: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah.

 

94:21 - Riding Mower - Parks Department

Councilman Evans moved, seconded by Councilman Vance to accept the low bid which met specifications. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were as follows: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah.

 

94:22 - Fencing - Parks Department

Councilman Perrin moved, seconded by Councilman Harpole to accept the low bid which met specifications. A roll call vote was taken resulting in all council members voting aye with the exception of Councilman Vance. Members voting aye were as follows: Evans, Mullenix, Bowers, Perrin, Kelton, Harpole, Mays and Hannah. Councilman Vance abstained from voting.

 

Councilman Mays offered a resolution requesting anti-crime legislation. Councilman Vance moved, seconded by Councilman Mullenix to table the resolution till the next council meeting so further research could be done. A roll call vote was taken resulting in all council members voting aye with the exception of Councilman Harpole. Members voting aye were as follows: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Mays and Hannah. Councilman Harpole voted nay.

 

Councilman Mays moved, seconded by Councilman Harpole for the reappointment of Lloyd McCracken to the MAPC with the term to expire April 1997. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were as follows: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah.

 

Councilman Vance moved, seconded by Councilman Perrin for the reappointment of Jon Coleman to the MAPC with the term to expire April 1997. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were as follows: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah.

 

Under new business Councilman Mullenix read a statement regarding diesel fumes and second hand smoke in Municipal Buildings. Councilman Mullenix explained he was not opposed to the smoke free ordinance, but felt the Council should address both problems.

 

Councilman Kelton gave a report regarding the Comprehensive Land Use study. He stated sometime in the coming week a Selection Committee would be announced and they would set a meeting date to review the nine (9) proposals.

 

Councilman Mays announced a Street Committee meeting at 6:00 p.m. on April 11, 1994. Afterwards a Public Hearing would be held regarding Ridge Crest drainage.

 

Vice Mayor Hannah recessed the regular council meeting until after the public hearing.

 

PUBLIC HEARING - 7:10 p.m. - A public hearing was held regarding the vacating and abandonment of an unimproved street between Belmont and Concord streets. Questions were raised regarding drainage, easements and the opening of Concord into Mr. Baker's shop.

 

Attorney Skip Mooney Sr. assured the Council all that is being done, at this time, is the vacating of the above mentioned unimproved street, not the opening up of Concord. Councilman Vance asked City Attorney, Pam Honeycutt, if the ordinance could be amended at a later date to include the appropriate utility and drainage easements. Attorney Honeycutt stated since this would not change the meaning of the ordinance it could be amended without returning for a first reading. No opposition was voiced.

 

Vice Mayor Hannah resumed the regular council meeting at 7:20 p.m.

 

Councilman Vance offered the following ordinance for the first reading:

 

AN ORDINANCE VACATING, CLOSING AND ABANDONING A 40 FEET WIDE DRIVE (UNNAMED STREET) BETWEEN BELMONT STREET AND CONCORD STREET, A DISTANCE OF 200 FEET, LOCATED IN RIDGECREST ADDITION TO THE CITY OF JONESBORO

 

Councilman Mays moved, seconded by Councilman Harpole to suspend the rules and place on second reading. A roll call vote was taken resulting in all council members voting aye. Those voting aye were: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah.

The following ordinance was on the third reading:

Mr. Bill Shelton spoke in opposition to the rezoning. Councilman Mays moved, seconded by Councilman Mullenix for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those voting aye were: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah. The ordinance was given the number 2545.

 

The following ordinance was on the third reading:

Mr. Bill Shelton spoke in opposition to the rezoning. Councilman Mays moved, seconded by Councilman Harpole for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those voting aye were: Evans, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah. The ordinance was given the number 2546.

 

With no further business the meeting was adjourned.
