AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING SAID ANNEXED TERRITORY RESIDENTIAL; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on September 13, 1984, and amended petition filed on January 2, 1985; and

 

WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro, Arkansas; and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on February 4, 1985, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and

 

WHEREAS, thirty days have expired since the order of annexation dated February 4, 1985, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of March 11, 1985.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of February 4, 1985, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be apart of parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants wherein the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Jonesboro Supper Club - Rankin - Mooney)

 

Tract 1: A part of the South Half of the Northwest Quarter of Section 32, Township 14 North, Range 4 East of the 5th Principal Meridian in Craighead County, Arkansas, more particularly described as follows: From the Southeast Corner of the South Half of the Northwest Quarter of said Section 32; thence North 89°48’00” West 237.71 feet along the South line of the South Half of the Northwest Quarter of said Section 32 to the point of beginning; continue thence North 89°48’00” West 1441.09 feet along the South line of the South Half of the Northwest Quarter of said Section 32 to a point on the Easterly right-of-way of Arkansas Highway 1 Business Route; thence North 42°59’39” West 233.64 feet along side right-of-way to appoint; thence South 89°50’50”East 408.17 feet to a point; thence North 01°16’29” West 290.04 feet to a point; thence South 89° 58’ 34” East 931.33 feet to a point; thence North 00°18’20” East 414.21 feet to a point; thence North 89°42’56” West 286.30 feet to a point; thence North 00°17’48” East 439.60 feet to a point on the North line of The South Half of the Northwest Quarter of said Section 32; thence South 89°19’12” East 800.54 feet along the North line of the South Half of the Northwest Quarter of said Section 32 to a point on an established fence line said point being some 8.5 feet West of the Northeast Corner of the South Half of the Northwest Quarter of said Section 32; thence South 04°35’03” West 85.22 feet along said fence to a point; thence South 02°07’14” West 124.03 feet along said fence to a point; thence South 00°57’56” West 100.00 feet along said fence to a point; thence South 02°06’42” West 100.00 feet along said fence to a point; thence South 02°17’01” West 100 feet along said fence to a point; thence South 02°31’07” West 100.00 feet along said fence to a point; thence South 02°27’40” West 100.00 feet along said fence to a point; thence South 02°21’08” West 100.00 feet along said fence to a point; thence South 02°26’05” West 39.0 feet along said fence to a point; thence South 01°37’04” West 54.42 feet along said fence to a point; thence South 01°30’58” West 99.76 feet along said fence to a point; thence South 00°35’32” West 99.30 feet along said fence to the point; thence North 89°48’00” West 208.71 feet to a point; thence South 00°35’32” West 208.71 feet to a point on the South line of the South Half of the Northwest Quarter of said Section 32, the point of beginning, containing some 27.79 acres, more or less, subject to a drainage easement 50 feet in width along the North side thereof, subject go a 10 foot utility easement South of and adjacent to said drainage easement of the North side and a utility easement 10 feet in width along the East side and subject to a 60 foot easement for ingress and egress as shown on the recorded plat thereof.

 

Tract 2: A part of the South Half of the Northwest Quarter of Section 32, Township 14 North, Range 4 East of the 5th Principal Meridian in Craighead County, Arkansas, more particularly described as follows; From the Northeast Corner of the South Half of the Northwest Quarter, said Section 32, thence North 89°09’12” West 809.04 feet along the North line of the South Half of the Northwest Quarter, said Section 32, to a point of beginning; thence South 00°17’48” West 439.60feet to a point: thence North 89°42’56” West 683.22 feet to a point; thence North 00°17’48” East 446.30 feet to a point on the North line of the South Half of the Northwest Quarter of said Section 32; thence South 89°09’12” East 683.25 feet to a point of beginning, containing some 6.95 acres, more or less, subject to a 50 foot drainage easement on the north side thereof and also subject to a street easement for ingress and egress, said street being 60 feet in width, 30 feet each side of a line described as follows: from the Northeast Corner of the South Half of the Northwest Quarter of said Section 32; thence North 89°09’12” West 1492.29 feet along the north line of the South Half of the Northwest Quarter of said Section 32 to a point; thence South 00°17’48” West 244.08 feet to the point of beginning of the 60 foot street easement aforesaid; thence Southeast 94.81 feet along a curve to the right, said curve having a central angle of 45°00’ and a radius of 120.71 feet; thence South 44°42’56” East 140.80 feet to the beginning of a curve; thence Southeast 94.81 feet along a curve to the left, said curve having a central angle of 45°00’ and a radius of 120.71 feet; thence South 89°42’56” East 142.45 feet to the beginning of a curve; thence Northeast 94.81 feet along a curve to the left, said curve having a central angle of  45°00’ and a radius of 120.71 feet; thence North 45°17’04” East 140.80 feet to the beginning of a curve; thence Northeast 94.81 feet along a curve to the right, said curve having a central angle of 45°00’ and a radius of 120.71 feet to a point on the East line of the above described property, said point being the ending point of the 60’ street easement described herein.

 

A part of the South Half of the Northwest Quarter of Section 32, Township 14 North, Range 4 East of the Fifth Principal Meridian in Craighead County, Arkansas, more particularly described as follows; From the Southeast Corner of the South Half of the Northwest Quarter of said Section 32; thence North 89°48’ 00” West 29.00 feet along the South line of the South Half of the Northwest Quarter of said Section 32 to the point of beginning; continue thence North 89° 48’00” West 208.71 feet along the South line of the South Half of the Northwest Quarter of said Section 32: to a point; thence North 00°35’32” East 208.71 feet to a point; thence South 89°48’00” East 208.71 feet to a point; thence South 00°35’ 32” West 208.71 feet to the point of beginning, containing some 1.00 acres more or less subject to a street easement for ingress and egress, said easement being 50 feet in width, 30 feet of which is east of the centerline as hereafter described and 20 feet of which is west of the centerline described as follows: From the Southeast Corner of the South Half of the Northwest Quarter of said Section 32; thence North 89°48’00” West 29.00 feet to a point; thence North 00°35’32” West 208.71 feet to a point; thence North 89°48’00” West 188.71 feet to the point of beginning of the 50 foot street easement aforesaid; thence South 00°35’32” West 79.39 feet to the beginning of a curve, thence Southwesterly 64.35 feet along a curve to the right, said curve having a central angle of 36°52’10” and a radius of 100.00 feet to appoint on the West line of the above described property and the end of the 50 foot easement herein described.

 

Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5 of the City of Jonesboro, Arkansas.

 

Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-3) for Tract 1 and Residential (R-2) for Tract 2.

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
