CITY COUNCIL MINUTES, DECEMBER 19, 1994

 

The Jonesboro City Council met in regular session, Monday, December 19, 1994, at 7:30 P.M. A full quorum was in attendance. Present were the Mayor, City Clerk, City Attorney, and all council members with the exception of Councilman Province who was unable to attend.

 

The minutes of December 5, 1994, were approved as mailed on motion by Councilman Vance seconded by Councilman Perrin. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

Councilman Perrin read the Mayor's proclamation honoring Dr. William Beasley for his achievements in education and for being named the 1994-95 School Superintendent of the Year. Dr. & Mrs. Beasley received a standing ovation by the Mayor, Council and everyone in attendance of the meeting.

 

Council members heard recommendations from Mr. Danny Honnell, Chairman of the Implementation Committee endorsing a proposed bond issue supported by a one-cent city sales tax to help finance prioritized traffic projects. The Implementation Committee recommended hiring a bond counsel to write a proposed ordinance calling for a sales tax referendum. Councilwoman Ingram inquired about a "Sunset Clause" on the proposed sales tax limiting the length of time the tax could be collected. Mr. Honnell stated the MATA committee is considering such a clause in the referendum. Mr. Robert Rees questioned how much would be spent on attorney fees and for selling the bond issues. Mr. Rees suggested having a limited sales tax and paying for each project as the money was collected. Mr. Honnell explained that state law prohibits a limited sales tax beyond three years. Mr. James Bedwell questioned if annexed areas would receive any of the money for street improvements such as paving of the streets. He stated annexed areas had been neglected while the rest of Jonesboro's streets had been paved. In response, Mr. James Hinds reminded everyone that several of the major projects to be addressed in the traffic plan are located in annexed areas.

 

Councilman Harpole offered the following ordinance for the first reading:

Councilman Evans moved, seconded by Councilman Harpole to suspend the rules and place on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

Councilman Kelton offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (Kathy Goodman)

 

Councilman Kelton moved, seconded by Councilman Harpole to suspend the rules and place on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

Councilman Vance offered the following ordinance for the first reading:

Councilman Bowers moved, seconded by Councilman Perrin to suspend the rules and place on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

Councilman Perrin offered the following ordinance for the first reading:

Councilman Harpole moved, seconded by Councilman Bowers to suspend the rules and place on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

The following bids were reviewed:

 

94:46 - Pest Control - Various Departments

Councilman Vance moved, seconded by Councilman Harpole to accept the low bid which met specifications. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

94:47 - Uniform Cleaning - Police and Fire Departments

Councilman Evans moved, seconded by Councilman Wise to accept the low bid which met specifications. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

Councilman Mays moved, seconded by Councilman Vance to approve a fifteen (15) day extension on a building permit for a home located at 815 Cate Street, as requested by Bill Aycock. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

Councilman Vance moved, seconded by Councilman Harpole to set an appeal hearing for January 3, 1995, as requested by Ms. Mary Mitchell, regarding a rezoning denial of property located at 500 Ridge Crest. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

Councilman Evans moved, seconded by Councilman Vance for the adoption of a resolution authorizing the condemnation of property located at 704 Warren and at 231 S. McClure. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah. The resolution was given the number 1994:72.

 

Under new business Councilman Harpole moved, seconded by Councilman Perrin to set the next council meeting for January 3, 1995, due to the New Year's holiday. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

Councilman Perrin moved, seconded by Councilman Kelton to appropriate $8,393.57 from unappropriated sales tax to cover election costs.

 

Councilman Harpole moved, seconded by Councilman Vance to accept the recommendation of the Professional Negotiations Committee to authorize Mayor Brodell to negotiate with three Little Rock law firms (Friday, Eldridge & Clark; Mitchell, Williams, Selig, Gates & Woodyard; Rose Law Firm), and to enter into any commitment that did not violate any compensatory ordinance or state statue. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah.

 

Councilman Mays offered the following ordinance for the first reading:

 

AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE PURCHASE OF A 1988 CATERPILLAR LIFT-TRUCK

 

Councilman Mays moved, seconded by Councilman Bowers to suspend the rules and place on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays and Hannah. Councilman Vance moved, seconded by Councilman Perrin to further suspend the rules and place on the third and final reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah. Councilman Mays moved, seconded by Councilman Kelton for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah. The ordinance was given the number 2593.

 

With no further business the meeting was adjourned.
