AN ORDINANCE  TO AMEND CHAPTERS 11.12 AND 11.16 OF THE JONESBORO CODE OF ORDINANCES, TO REPEAL ORDINANCES # 1695, #2186, #2174,#2393, AND  FOR THE PURPOSE OF ADOPTING THE 1995 ARKANSAS STATE PLUMBING CODE, SEVENTH EDITION AND ADOPTING THE 1995 ARKANSAS STATE GAS CODE, INCLUDING ANY AND ALL FUTURE AMENDMENTS AND/OR EDITIONS TO BOTH CODES WHICH MAY FOLLOW HEREAFTER, LESS AND EXCEPT THE LOCAL EXCEPTIONS AS SPECIFIED HEREIN (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-99:1247 ON JULY 19, 1999; ORD-08:094 ON NOVEMBER 6, 2008; ORD-08:097 ON NOVEMBER 6, 2008)

WHEREAS, it is the desire of the City of Jonesboro, Arkansas to adopt the 1995 Arkansas State Plumbing Code, Seventh Edition, and the 1995 Arkansas Gas Code and all future amendments and/or editions which may follow, to establish minimum requirements for safe plumbing and gas installations so as to safeguard the life, health and public welfare and the protection of property within  the City of Jonesboro, Arkansas and in other areas that are connected to the water supply of The City Water & Light Plant.
 
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas that;
 
SECTION 1: That Section 11.12.02 (a) is amended to read as follows: There is hereby adopted by the City of Jonesboro, Arkansas a certain plumbing code known as the 1995 Arkansas State Plumbing Code, Seventh Edition, less and except those portions that are deleted, modified or amended as specified in this ordinance.  
 
SECTION 2: The following amendments to the 1995 Arkansas State Plumbing Code, Seventh Edition shall govern locally and shall be exceptions to the plumbing code.
 
(A)  Section 2.26.1 is hereby amended to read as follows: Lead.  Four inch (4")lead bends and stubs or PVC Schedule 40 plastic pipe may be used on water closets or similar connections.  Cellular core pipe cannot be used for any plumbing installation.
 
(B)  Section 2.26.2 is hereby amended to read as follows: Iron or PVC.  Four inch (4") waste with cast iron flange or PVC Schedule 40 plastic flange may be used on concrete floors or on conventional floors.  Cellular core pipe cannot be used for any plumbing installation.
 
(C)  Section 2.26.3 is hereby deleted in its entirety.
 
(D)  Section 11.1.2 is hereby amended to read as follows: Above ground piping with buildings.  Soil and waste piping for a drainage system within a building shall be of cast iron, lead, brass, PVC Schedule 40 plastic pipe, or copper pipe or copper tube.  Cellular core pipe cannot be used for any plumbing installation.
 
(E)  Section 11.5.5 is hereby amended to read as follows:  Minimum size of stack vent or vent stack.  Any structure on which a building drain is installed shall have at least one stack vent or vent stack carried full size through the roof not less that three inches (3") in diameter.  
 
SECTION 3: The following amendments to the City of Jonesboro Code of Ordinances shall govern locally and shall be exceptions to the 1995 Arkansas State Plumbing Code.  
 
(A)  Sections 11.12.01, 11.12.03, 11.12.07, 11.12.08, 11.12.09 and 11.12.10 of the City of Jonesboro Code of Ordinances is hereby deleted in their entirety.
 
(B)  Section 11.12.11 of the City of Jonesboro Code of Ordinances is hereby amended to read as follows:
 
(1)  Prohibition of non-metallic piping or fittings.  The use of non-metallic piping or fittings are hereby specifically prohibited in the new installation or repair of water supply within or under a building or structure within the area of inspection jurisdiction of the Plumbing Inspector for the City of Jonesboro, Arkansas.
 
(2)  Non-metallic piping and fittings may be used for drain, wastewater and vents as specified in Section 2(A), 2(B) & 2(D) of this ordinance.
 
(3)  When non-metallic piping and fittings are used in new installations or repair of plumbing as noted in Section 2 (A), 2(B) and 2(D) of this ordinance, they shall be installed using a colored pipe cleaner meeting manufacturer's specifications and with the manufacturer=s recommended glue product.
 
(C)  Section 11.12.04 of the City of Jonesboro Code of Ordinances is hereby amended to read as follows: Permits and Fees, notice for inspection required.
 
(1)  11.12.04 (a) is hereby deleted in its entirety.
 
(2)  Section 11.12.04 (b) is hereby amended as follows:  The fees for inspection of plumbing installations shall be in accordance with the following fee schedule:
(a)  Rough-in inspection, five dollars ($5.00)
(b)  Water heater, five dollars ($5.00)
(c)  Each plumbing fixture and waste discharging device, two dollars ($2.00) each
(d)  Sprinkler back flow preventer, ten dollars ($10.00)
(e)  Sewer stub out, two dollars ($2.00)
(f)  Water meter, five dollars ($5.00)
(g)  Sewer connection, five dollars ($5.00)
(h)  Reinspection fee, fifteen dollars ($15.00)
(i)  Permit issuance fee, residential and commercial ten dollars ($10.00)
(j)  Street cuts, twenty-five dollars ($25.00)
 
(D)  Notice for inspection notification.  Any person, firm or corporation installing a plumbing work shall be required to notify the plumbing inspector when the work being performed is ready for a required inspection.  The plumbing inspector shall perform the requested inspection within twenty-four (24) hours after receiving the request.
 
(E)  Section 11.12.05 of the City of Jonesboro Code of Ordinances is hereby amended to read as follows: Bond.  Every master plumber doing business in the City of Jonesboro shall execute and deliver to the City a bond, with a surety bonding company, in the amount of Ten Thousand Dollars ($10,000) to indemnify the City or any citizen for any damage caused by the failure of such master plumber to comply strictly with the provisions of this chapter.  No plumbing permit shall be issued to any master plumber unless this bond has been delivered to the City and is in full force and effect.
 
(F)  Section 11.12.06 of the City of Jonesboro Code of Ordinances is hereby amended to read as follows: Street cuts.  
 
(1)  All street cuts made in the public streets or alleys must be made as carefully as possible and all materials excavated from the trenches shall be removed or placed where the least inconvenience to the public will be caused.  
 
(2)  All street cuts are to be repaired per Section 9.32.06 (B) (1)(b) of the City of Jonesboro Code of Ordinances.  If the plumber fails to repair the street to the satisfaction of the City Engineer the plumber will not be issued any plumbing permits until such repairs are made.
 
(3)  All street cuts be marked with sufficient barriers.  Yellow lamps shall be maintained around the opening at night and all other precautions shall be taken by the plumber or excavator to protect the public from damage to person or property.
 
(4)  All street cuts shall require a permit and inspection.  Advance notice, minimum of at least 24 hours, must be given to the 911 Center, the Fire and Police Departments and all other emergency vehicle operators prior to making such cut.
 
SECTION 5: The following amendments to the City of Jonesboro Code of Ordinances shall govern locally and shall be exceptions to the 1995 Arkansas State Gas Code.
(A)  Sections 11.16.01, 11.16.02, 11.16.03, 11.16.04, 11.16.05, 11.16.06, 11.16.07, 11.16.11 and 11.16.12 are hereby deleted in their entirety.
 
(B)  Section 11.16.08 of the City of Jonesboro Code of Ordinances is hereby amended to read as follows: Permits and fees - notice of inspection required.
 
(1)  Section 11.16.08 (b) is hereby amended as follows:  The fees for consumer gas piping inspections shall be in accordance with the following fee schedule:
(a)  Gas pressure inspection, ten dollars ($10.00)
(b)  Unit heaters, wall heaters and floor furnaces, five dollars ($5.00)
(c)  Gas outlets, two dollars ($2.00) for one to four outlets.  All outlets above four shall be fifty-five cents ($0.55) per outlet.
(d)  Permit issuance fee, residential and commercial ten dollars ($10.00)
 
(C)  Sections 11.16.09(a) and 11.16.09(b) of the City of Jonesboro Code of Ordinances are hereby deleted in their entirety.
 
(1)  Section 11.16.10 is hereby amended to read as follows: Certificates.  The inspector shall issue a certificate or approval at the completion of the work for which a specific permit has been issued.  If after inspection it is found that such work complies with the provisions of this chapter and all other requirements of law or ordinances applicable thereto.  A duplicate of each certificate shall be delivered to the gas company and used as its authority to grant gas service.
 
(2)  Section 11.16.09 8 of the City of Jonesboro Code of Ordinances is hereby amended to read as follows: An inspection of gas piping shall be required if the gas has been off or disconnected for a period of twelve (12) months or more.  A new inspection certificate shall be required to be issued to the gas company.
 
(D)  Section 11.16.13 (a) of the City of Jonesboro Code of Ordinances is hereby amended to read as follows:
 
(1)  All pipe installation, extension, alteration or repair of any house gas piping shall be of standard weight and standard dimension black wrought iron or black steel pipe, except that approved flexible connectors may be used as appliance connectors not exceeding thirty inches (30") provided a manual gas cut-off is installed between such connector and such piping.
 
(2)  Section 11.16.13 (b), 11.16.13 (c), 11.16.13 (d) of the City of Jonesboro Code of Ordinances are hereby deleted in their entirety.
 
(3)  Section 11.16.14 of the City of Jonesboro Code of Ordinances is hereby amended as follows: Consumer's gas piping.
(a)  Section 11.16.14(a) is hereby amended to read as follows:  All gas service piping from the point of delivery to the first outlet of gas shall not be less than one and one-quarter inches (1 1/4") in diameter.
(b)  Section 11.16.14(e) is hereby amended to read as follows: Gas outlets for instantaneous water heaters and gas ranges shall not be less than three-fourths inch (3/4") pipe and all outlets for central heating plants not less than one inch (1") pipe.
(c)  Sections 11.16.14(b), 11.16.14(c), 11.16.14(d), 11.16.14(f), 11.16.14(g), 11.16.14 (I), 11.16.14(j), 11.16.14(k) and 11.16.14(l) are hereby deleted in their entirety.
(d)  Section 11.16.14(h) is hereby amended to read as follows: Table of minimum sizes for house piping shall be in accordance with the following chart:

(E)  Sections 11.16.15, 11.16.16, 11.16.17, 11.16.18, 11.16.19, 11.16.20, 11.16.21, 11.16.22, 11.16.23, 11.16.24 and 11.16.25 of the City of Jonesboro Code of Ordinances are hereby deleted in their entirety.
 
SECTION 6: Material Standards for Sanitary Sewer Lines Under Street and Highway Right of Ways.
 
(A)  All sanitary sewer service lines that are installed and/or repaired in the street right of way within the City of Jonesboro shall be constructed of cast iron, Schedule 40 PVC or equivalent materials.  
 
(1)  When materials other than cast iron or Schedule 40 PVC are to be used, proof of the equivalency shall be submitted to the Engineering Department of City Water & Light and to the Plumbing Inspector for the City of Jonesboro and approval obtained prior to the installation or repair.
 
(B)  All sanitary sewer service lines which are constructed with a bell or coupling hole shall be installed in such a manner as to provide a uniform and continuous support of the pipe barrel between the bell or coupling hole.
 
(C)  Prior to the installation of any sanitary sewer service lines, any accumulation of excess water that may have occurred in the trench shall be removed by means other than discharging the accumulation into a sewer main.
 
(D)  All sanitary sewer permits issued by City Water & Light (CW & L) shall be available on the job site at all times while repair or installation is underway.  After the repair or installation has been completed, inspected and approved by a CW & L inspector, the CW & L Inspector shall sign the permit stating such approval.
 
(E)  All sanitary sewer service lines installed and/or repaired within the street right of way under the jurisdiction of the Arkansas Transportation and Highway Department (AHTD), the method of construction and material specifications shall be according to current AHTD standards.
 
SECTION 7: Ordinances #1695, #2174, #2186 and # 2393 are hereby repealed.
 
SECTION 8: Any person, firm or corporation who fails to comply with or violate any of the provisions of this chapter shall be deemed guilty of a misdemeanor and in addition to the penalty prescribed in Section 1-8, the license of such person may be revoked.  
 
SECTION 9: The plumbing inspector shall not be connected in any way with any person, firm or corporation directly or indirectly engaged in the business of plumbing or plumbing supplies.
 
SECTION 10: No less than three (3) copies of the plumbing and gas codes shall be on file in the office of the City Clerk of the City of Jonesboro, Arkansas.
 
SECTION 11: The Board of Adjustment and Appeals as set forth in Section 105 of the 1992 Arkansas Fire Prevention Code, Volume II shall serve as the appeals board for decisions regarding interpretations of the plumbing and gas codes.
 
SECTION 12: All ordinances or parts of ordinances which are contrary to this ordinance are hereby repealed to the extent of such conflict.  It is further declared that if any phrase, clause, sentence, paragraph, chapter, title, or section of this code shall be declared unconstitutional, such unconstitutionality shall not effect any of the remaining phrases, clauses, sentences, paragraphs, chapters, titles and sections of this code.
 
SECTION 13: It is found and declared by the City Council of the City of Jonesboro, Arkansas that this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its' passage and approval.
 
PASSED AND ADOPTED this 20th day of April, 1998.
