AN ORDINANCE TO CONDEMN A HOME LOCATED AT 519 EAST CATE, JONESBORO, ARKANSAS TO IMPOSE A LIEN UPON SAID PROPERTY AND TO REMOVE SUCH STRUCTURE FROM SAID PROPERTY AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: That Mrs. Ann Petroske is the owner of the following described property and that said owner is hereby ordered to remove or raze said building upon said property within thirty (30) days from the effective date of this Ordinance.

 

Section 2: That said property is hereinafter set forth in this Section, giving the legal description of same and the hazards which said property constitutes to the Citizens of Jonesboro, Arkansas, the same being as follows: Said property is located in Craighead County, Arkansas and is described as Lot 3, Block 5, Matthews Addition to the City of Jonesboro, Arkansas. Said structure is deficient as follows: Plumbing facilities within the structure are not installed and maintained in good sanitary working condition; the hot and cold water supply is in a serious state of disrepair; the heating facilities are completely sub-standard; said equipment for cooking is not adequate to meet minimum standards; the entire wiring system within this structure is considered unsafe for use, the exterior walls are deteriorated and have not been kept in repair; the roof is in danger of collapse due to age and lack of repair; front and back porches are extremely dilapidated; the windows and doors in this structure are completely missing or deteriorated; the windows that are not missing or broken are in violation of building codes; the window sashes are not properly fitted and weather tight; the windows in this structure are not easily opened and secured in position; the exterior doors are not provided with proper hardware and are not maintained in good condition; the exterior door frames are not fit reasonably well within their frames and does not exclude wind or rain from entering the building; it is estimated that this structure has not had protective treatment within the past seven (7) years; the assessors structures to the principal structure are sub-standard and do not meet the minimum building code standards; the floors, walls ceilings in this structure are dilapidated and need extensive replacement throughout the structure; there is a serious deterioration of the roof system, the rear half of the structure is in danger of collapse because of deficiency in the supports.

 

Section 3: The City Attorney is hereby directed to institute such legal proceedings, as may be necessary, in order to enforce the provisions of this Ordinance and to remedy the dangers and unsightly conditions brought about as a result of the failure of the owner to properly keep up said property.

 

Section 4: That said legal proceeding shall provide that unless the house is razed within a certain period to be allowed by the Court, the City of Jonesboro, Arkansas is hereby authorized to raze said property and have a lien upon the real estate for the cost of removing said house.

 

Section 5: That all ordinances or part of ordinances in conflict herewith are hereby repealed to the extent of said conflict.

 

Section 6: The City Council finds and declares that the structure owned by Mrs. Ann Petroske is in such a dilapidated and hazardous condition as to constitute a fire and health hazard to the citizens and residents, whose property adjoin the property in question and that this Ordinance needs to be put into effects immediately to protect the public peace, health and safety of the citizens of Jonesboro, Arkansas and therefore an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from and after its passage and approval.

 

PASSED and ADOPTED this 7th day of July, 1980.
