METROPOLITAN AREA PLANNING COMMISSION

AUGUST 13, 1996

 

MEMBERS PRESENT:  Coleman, Little, Damron, Gardner, Finley,                      Beadles, Pitts, Shaw and Phillips

 

Minutes of the July 9, 1996 meeting were approved as submitted.

 

#1 PUD96-3  Phillip A. Jones requested final approval of plans for a residential planned unit development containing 15 units, on 15 lots on 1.54 acres.  The property is located on the south side of Matthews Avenue, between Parr Street and Witt Street.

 

Jim Pitts, Landscape Architect, presented plans on landscaping for the project. 

 

Ms. Shaw moved to approve the request subject to plat being revised to show the sanitary sewer easements on Lot 8, 9 and 10 and the architect completing the landscape plan.  Mr. Little seconded, 7 voted aye, 0 no, one abstained, REQUEST APPROVED WITH STIPULATIONS.

 

#2 PUD96-2  St. Bernards Foundation requested final approval of plans for a Residential Planned Unit Development to be located on the north side of Highland Drive, south of Wilkins Avenue and west of Metzler Lane.

 

Aubrey Scott showed pictures of the property with some clearing that has taken place which shows street and building locations.  Actual construction is expected to begin in November.  Mr. Scott informed the commissioners of plans to not install any fencing at this time and to wait at least one year to see if the natural vegetation is sufficient for a buffer or if the neighbors would want fencing.

 

Ms. Shaw made a motion to approve the request subject to:

1.  Approval of POA by City Attorney

2.  Drainage plans approved by City Engineer

3.  Fence or buffering option on west property line to be resolved as stated in the letter sent to adjoining property owners

Ms. Finley seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#3 RZ96-26  Keith Meredith requested approval of rezoning from Residential R-1 to Residential R-2 for .33 acre located on the southeast corner of Nettleton Avenue and Smoot Drive.

 

Andrew Jackson, who owns adjoining property, objected to the zoning change.  Commissioners were also made aware of other calls that had been received from other neighbors.  Though zoned R-2, the majority of the surrounding development is single family.  There was considerable discussion about the right of way needed for Nettleton Avenue as well.

 

Ms. Shaw moved to deny the request stating the plat appears to create an unusable piece of land.  Ms. Shaw further stated that the contiguous land development makes this proposal out of character with the neighborhood.  Mr. Pitts seconded, 7 voted aye, 1 no, REQUEST DENIED. 

 

#4 MP96-20  Keith Meredith requested approval of a one lot minor plat containing .33 acre and located on the southeast corner of Nettleton Avenue and Smoot Street.

 

Mr. Pitts moved to approve the minor plat subject to 40' of right of way being shown on Nettleton Avenue.  Mr. Hamman stated that the owner is in agreement with this.  The developer is also to provide full street improvements, with plans to be approved by the City Engineer, on Smoot and Nettleton and a 10' utility easement along the south property line.  Mr. Damron seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.  

 

#5 PP96-7  Keith Meredith requested preliminary approval of subdivision plans for Meredith Subdivision Phase II containing 6 lots on 1.55 acres.  The property is located on the south side of Nettleton Avenue, east of Smoot Drive. 

 

Mr. Pitts moved to give preliminary approval subject to the following plat revisions:

1.  Showing existing street placement, curb to curb with curves

2.  Location of opposing street

3.  Sight distances being added to plans

4.  40' right of way from centerline on Nettleton Avenue

Dr. Beadles seconded, 7 voted aye, 0 no, one absent for vote, REQUEST APPROVED WITH STIPULATIONS. 

 

#6 RZ96-26  Don Hudson requested approval of rezoning from Residential R-1 to Industrial I-2 for 35.61 acres located on the northeast corner of C. W. Post Road and Cottage Home Road.

 

Mr. Damron moved to approve the request stipulating platting and site plan to be done before development.  Ms. Shaw seconded, 8 voted aye, 0 no, REQUEST APPROVED. 

 

#7 RZ96-27  Skip Macon requested approval of rezoning from Residential R-1 to Commercial C-3 for Lots 1, 2 & 3, Block A of Sunset Hills Addition.  The property is located on the southwest corner of Johnson Avenue and Jewell Drive.

 

One property owner voiced concerns about existing drainage problems being further complicated with this development.  It was stated that the Street Department was aware of the problem and should be acting soon to correct the problem.

 

Mr. Pitts moved to approve the rezoning subject to an additional 10' ROW on Johnson Avenue along the lots where only 50' is shown.  Part of the property is showing 60' currently.  Mr. Pitts further stipulated that a site plan be approved by the MAPC before development.  Mr. Phillips seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#8 RZ96-28  Frankie Dacus requested approval of rezoning from Residential R-1 to Commercial C-3 for .72 acre located on the southwest corner of N. Church Street and Thomas Green Road.

 

Mr. Damron moved to table this item as there was no representative of this item present.  Ms. Shaw seconded, 8 voted aye 0 no, REQUEST TABLED.

 

#9 RZ96-29  Nuckles and Sons requested approval of rezoning from I-2 to I-2 for 1.69 acres located on the west side of N. Culberhouse Street, south of Gordon Street.

 

A motion to approve the request as submitted was made by Dr. Beadles and seconded by Ms. Shaw.  Voting was 8 in favor, 0 opposed.  REQUEST APPROVED.

 

#10 SP96-22  James Darnell requested approval of site plans for two residences to be added to an existing home at 1115 W. Jefferson Avenue.

 

It was pointed out that the density of the proposal is 15 units per acre which is more than what is allowed in R-2 zoning.  Access between this house and the adjoining property is narrow, approximately 14' for the first 70'.  Discrepancies in the plan show the lot widening to 63', however, the lot is only 60' wide.  Accessible parking was also discussed as a major concern. 

 

Dr. Beadles made a motion to deny the request stating the property is being over developed, plans are not accurate and not consistent with the development of the surrounding area.  The motion was seconded by Mr. Damron, 8 voted aye, o no, REQUEST DISAPPROVED.

 

#11 SP96-18  M & W Pizza, Inc. requested approval of plans for a retail center to be located on the east side of Stadium Blvd., north of Race Street and south of Meador Road.

 

Most discussion related to drainage, access to the property, left turns off Race Street, 20' one way drive on east side of the lot mixed with parking, utility pole locations, sewer easements splitting the building and useable parking.

 

Mr. Pitts moved to approve the request subject to:

1.  Additional drainage facilities on north and south property lines being added to prevent over land drainage from site

2.  Creating a left turn lane on Race for east bound traffic

3.  Back drive, one way north labeling

4.  Guy wire location in easement adjacent to building with CW&L approval.  Wire cannot be located in drive or any parking  5.  Curb on east side 6" tall to prevent drainage onto residential properties

6.  6' wooden privacy fence along the entire east line of property

7.  Specify dimensions on the drives

8.  Written permission from CW & L on the sewer easement and its location to adjoining buildings

 

Dr. Beadles seconded, 3 voted aye, 5 voted no, REQUEST DENIED.  Reasons for denial was given as high traffic volume area, creating a dangerous situation with left turns near intersections, improper drainage, too much building for small site and if any of the stipulations are not met it cancels the plan. 

 

#12 SP96-24  Robert Rees requested approval of site plans for three buildings to be built on 2.96 acres located at 4812 E. Highland Drive.

 

Item WITHDRAWN at request of owner after discussion concerning deficiencies in the plans, some relating to drainage and its location in the flood plain, parking, proposed use of the property.

 

#13 SP96-23  Ed Mason, at 508 Kelsey Drive, requested approval to establish a second residence for a dependent relative.

 

Owner stated this is not to be a rent house, but will be used for an elderly family member, then a guest house for children when they visit.  Commission members stressed that this is not to be used as rental or commercial property.

 

Mr. Damron moved to approve the request, seconded by Ms. Shaw.  Eight voted aye, 0 no, REQUEST APPROVED.

 

#14 PP96-8  Bob Gibson requested preliminary approval of subdivision plans for Griffin Park, containing 19 lots on 5.54 acres and located on the north and west sides of Oak Park Circle.

 

Dr. Beadles moved to give preliminary approval subject to staff comments on drainage, utility easements and on change the street name of the western street.  The street improvements will depend on the outcome of whether the existing development enters into a street improvement district for Oak Park Circle.  If this is not worked out then full street with no curbs and gutters, or half street with curbs and gutters.  Mr. Damron seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#15 MP96-26  Bob Haun requested approval of a one lot containing .578 acre and located on the west side of Tower Park Drive, north of Skyline Cove.

 

Mr. Pitts moved to approve the request, seconded by Ms. Finley.  Eight voted aye, 0 no, REQUEST APPROVED. 

 

#16 SP96-25  Dean Tyrer requested conceptual approval of plans for expanding Meadowview Trailer Park.  The property is located at 4303 Aggie Road, east and south of the existing park.

 

Dr. Tyrer's proposal calls for expansion of the park by 165 or 175 spaces.  Existing park has 100 spaces currently.  Proposal calls for a systems of interconnecting greenways, elimination of private sewerage ponds, and widening of existing narrow roads.  No vote was taken on this conceptual plan.

 

#17 AZ96-1  Bob Trout, Mike Young and others requested approval of annexation and zoning for 441.54 acres located on a part of the north one half of Section 34, T15N, R4E; the NE 1/4 of the SE 1/4 of Section 34, T15N, R4E; the north one half of the SW 1/4 of Section 35, T15N, R4E; the south one half of the NW 1/4 of said Section 35; a portion of the NE 1/4 of the NW 1/4 of said Section 35.  A zoning classifications of Residential R-3 is requested for 426.34 acres and Commercial C-3 is requested for approximately 15.2  acres.  The property is generally located on the east side of Highway 351, north of Oak Ridge Estates Subdivision, on the south side of Macedonia Road.

 

A residential development around a golf course is planned for the property.  Conceptual plans call for varied residential development including typical single family, estate acreage, townhouses, condominiums and apartments and also includes several acres of commercial development to serve the residents.

 

Dr. Beadles moved to approve the request contingent upon county release of the property and the city's acceptance of the land.  Mr. Gardner seconded, 6 voted aye, 0 no, 2 abstained, REQUEST APPROVED.
