AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED DECEMBER 19, 1975; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-76:2217 ON APRIL 5, 1976)

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on November 13, 1975, and
WHEREAS, said petition for the annexation of said land was signed by all the real estate owners owning all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting down a hearing upon said petition was entered, notice was duly published of said hearing, and the hearing upon said petition was duly had and held in the County Court on December 19, 1975, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands herein described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and
WHEREAS, 30 DAYS HAVE EXPIRED SINCE THE ORDER OF ANNEXATION DATED December 19, 1975, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas and said annexation proceedings were and all things confirmed by the County Court by its order of January 19, 1976.
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, by its order of December 19, 1975, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the residents residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
A part of the Northwest Quarter of the Southeast Quarter of Section 23, Township 14 North, Range 3 East, Craighead County, Arkansas and being more particularly described as follows: Commencing at the Southwest Corner of the Northeast Quarter of the Southeast Quarter of Section 23 aforesaid being the Northeast Corner of Lot 5, Block B, Briarwood 4th Addition; thence South 89°27' West 140.6 feet; thence North 1°44' East 33.4 feet; thence South 82°43' West 60 feet to the Southeast Corner of Lot 1, Block A, Briarwood 5th Addition and point of beginning proper; thence North 68° 19' West 160 feet; thence North 78°44' West 185.7 feet; thence North 81°13' West 202.7 feet; thence North 73°22' West 209.4 feet; thence North 72°04' West 210.9 feet; thence North 65°29' West 175.4 feet; thence North 1°06' East 324.94 feet; thence South 65°29' West 153.9 feet; thence South 48°39' East 90.0 feet; thence along the arc of a curve to the right with a radius of 104.13 feet for distance of 59.4 feet; thence North 74°02' East 95.34 feet; thence South 15°58' East 175 feet; thence North 74°04' East 159 feet; thence South 72°40' East 82.2 feet; thence 80°14' East 323.05 feet; thence South 3°35' West 9.85 feet; thence South 84°53' East 199.6 feet; thence South 3°35 West 191.1 feet; thence along the arc of a curve to the left with a radius of 285.3 feet for a distance of 54.1 feet; thence South 7°17' East 100 feet; thence South 82°43' West 60 feet to the point of beginning proper and containing 8.44 acres more or less; the same also described as Briarwood 5th Addition as shown by recorded plat in Deed Record 198 at page 47.
Section 3: The lands and territory annexed to the City of Jonesboro, Arkansas, are hereby accepted by the City of Jonesboro, and hereby assigned and attached to Ward 5 of the City of Jonesboro, Arkansas.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme emergency that the territory herein be immediately annexed to and accepted by the City of Jonesboro; and that it is in the interest of the City of Jonesboro that citizens and property of said territory set out above be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this Ordinance is necessary for the preservation of the public peace, health and safety.
