AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORIES TO A PARTICULAR WARD 6; DECLARING THE ZONING FOR THE ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of a particular tract to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on October 23, 1985; and

 

WHEREAS, said petition for the annexation of these lands was duly signed by the majority of the owners of all the tract to be annexed to the City of Jonesboro, Arkansas; and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead, Arkansas, on November 26, 1985, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and

 

WHEREAS, thirty days having expired since the order of annexation dated November 26, 1985, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of December 27. 1985.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of November 26, 1985, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing herein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro. Arkansas.

 

Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Jack Grimes and others N. side of Hwy 18 East, 453.36 Acres - Charles Frierson)

 

Beginning at the NW corner of Section 25, Township 14 North, Range 4, East; thence 60’ to a point of beginning proper being in the City Limits of Jonesboro, Arkansas; thence East 110’ thence North 220’, thence west 80’, thence North 296.9’, thence East 1320.8’ thence North 803.1’, thence West 1295’, thence North 2172’, thence East 350’, thence North 285.94’, thence West 160’, thence North 183’, thence East 20’, thence North 1110’, thence East 660’, thence North 240’, thence West 2200’ along the North border of an existing County Road, thence South 616.5’, thence East 670.0’ thence North 346.5’, thence East 220’, thence North 2’, thence East 208’, thence South 300’, thence West 208.5’, thence South 800’, thence West 1800’, thence North 1320’, thence West 208’, thence South 1320’, thence West 208’, thence North 1320’, thence West 490’ along the North border of an existing County Road to the existing Missouri Pacific Railroad, thence South Southwest 4000’parallel and adjacent to said railroad, thence South 650’, along the West border of an existing County Road, thence East 2625.1, thence South 1320’, thence East 500’, thence North 400’, thence East 500’, thence South 400’, thence East 1650’, along the North right-of-way of Arkansas State Highway #18 returning to the point of beginning proper.

 

Section 3: The lands and territory annexed to the City of Jonesboro and hereby assigned and attached to Ward 6.

 

Section 4: Said lands and territory annexed to the City of Jonesboro are hereby classified for purposes of zoning according to the following;

 

TRACT 1 - AGRICULTURAL 1 - The Southeast Forth of the Northwest Quarter and all that part of the Northeast Fourth of the Northwest Quarter that lies east of the right-of-way of the St. Louis, Iron Mountain & Southern Railroad; all in Section 23, in Township 14 North, of Range 4 East of the Fifth Principal Meridian, and containing in all 67.37 acres, more or less; subject to all existing public and private roads and easements. AND

 

All that part of the Northwest Quarter of the Southeast Quarter, and of the Southwest Quarter of the Northwest Quarter of Section 23 lying south and east of the St. Louis, Iron Mountain & Southern Railroad; and also the Northeast Quarter of the Southwest Quarter of Section 23, all in Township 14 North, Range 4 East.

 

TRACT 2 - AGRICULTURAL 1 - The South Half of the Northeast Quarter and the Southeast Quarter of Section 23, Township 14 North, Range 4 East, LESS AND EXCEPT THE FOLLOWING FOUR PARCELS:

 

(1)                     A part of the Southeast Quarter of Section 23, Township 14 North, Range 4 East, more particularly described as follows: Begin at the Southeast corner of Section 23 aforesaid; thence West along the Section line 763.8 feet; thence North 0°32’ West 43.3 feet to the north right-of-way line of State Highway No.18, the point of beginning proper; thence North 0°32’ West 195.0 feet; thence South 89°39’ West 75.0 feet; thence South 0°32’ East 195.0 feet to the North right-of-way line of State Highway No.18; thence North 89° 39’ East along said right-of-way line 75.0 feet to the point of beginning proper, containing 0.3357 acres in Craighead County, Arkansas.

(2)                     Part of the Southeast Quarter of the Northeast Quarter of Section 23,, Township 14 North, Range 4 East, more particularly described as follows: Beginning at the Southeast corner of said Southeast Quarter of the Northeast Quarter; thence run West to the West line of the County Road for the point of beginning proper; thence run West 171 feet to the East line of a ditch; thence run North along the East line of said ditch 254.7 feet; thence run East 171 feet to the West line of the County Road; thence run South along the West line of the County Road 254.7 feet to the point of beginning proper, containing 1 acre, more or less.

(3)                     Part of the Southwest Quarter of the Southeast Quarter of Section 23, Township 14 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows: Begin at the Southwest corner of the South-west Quarter of the Southeast Quarter of Section 23, Township 14 North, Range 4 East; thence East on the Section line 417.5 feet; thence North 0°12’ West 56.1 feet to the North right-of-way line of Arkansas State Highway #18, the point of beginning proper; thence North 0°12’ West 412 feet; thence East 496.1 feet; thence South 0° 12’ East 410.8 feet to the North right-of-way line of Arkansas State Highway #18 aforesaid; thence South 89° 53’ West along said right-of-way line 496.1 feet to the point of beginning proper, containing 4.7 acres.

(4)                     A part of the Southeast Quarter of the Northeast Quarter of Section 23, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Northeast Corner of Section 23 aforesaid; thence South along the Section line 1662.5 feet to the point of beginning proper; thence continue South 105.0 feet; thence West 210.0 feet; thence North 105.0 feet; thence East 210.0 feet, to the point of beginning proper, containing 0.50 acres, and being subject to a 22 foot Road Easement along the East side of Tract.

 

TRACT 3 - AGRICULTURAL 1 - A part of the Southwest Quarter of the Southwest Quarter of Section 24, Township 14 North, Range 3 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Southeast corner of the Southwest Quarter of the Southwest Quarter aforesaid; thence North 503 feet to the point of beginning; thence South 89° 10’ West 1320.8 feet; thence North 453.1 feet; thence North 89° 10’ East 275 feet; thence North 350 feet; thence North 89°10’ East 1045.8 feet; thence South 803.1 feet, returning to the point of beginning proper, containing 22.14 acres, more or less.

 

TRACT 4 - RESDIENTIAL 2 - A part of the Southwest Quarter of the Southwest Quarter of Section 24, Township 14 North, Range 4 East, more particularly described as follows: Commencing at the Northwest corner of the Southwest Quarter of the Southwest Quarter of Section 24 aforesaid; thence North 89° 10’ East 25.0 feet to the point of beginning proper; thence North 89° 10’ East 25.0 East 250.0 feet; thence South 350.0 feet; thence South 89°10’ West 250.0 feet; thence North 350.0 feet to the point of beginning proper, and containing in all 2.0 acres, more or less. 

 

TRACT 5 -RESIDENTIAL 2 - A part of the Southwest Quarter of the Southwest Quarter of Section 24, Township 14 North, Range 4 East, more particularly described as follows: Beginning at the Southwest corner of the intersection of Lake City Highway #18 and the County Road, run thence North 70 yards, thence East 35 yards, thence South 70 yards, thence West 35 yards to the point of beginning, containing one-half acre.

TRACT 10 - RESIDENTIAL 2 - A part of the Southeast Quarter of the Northeast Quarter of Section 23, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Northeast Corner of Section 23 aforesaid; thence South along the Section line 1662.5 feet to the point of beginning proper; thence continue South 105.0 feet; thence West 210.0 feet; thence North 105.0 feet; thence East 210.0 feet to the point of beginning proper, containing 0.50 acres, and being subject to a 22 foot Road Easement along the East side of Tract.

 

TRACT 11 - RESIDENTIAL 2 - Begin at the Northwest corner of the Southwest Quarter of the Northwest Quarter of Section 23, Township 14 North, Range 4 East; thence South along the East section line of Section 23, 468.94 feet to a point of beginning proper; thence East 350 feet; thence North 285.94 feet; thence West 160 feet; thence North 183 feet; thence East 20 feet; thence North Parallel to the East section line of Section 23, 1110 feet; thence East parallel to the North section line of Section 24, 616.25 feet; thence North 208.75 feet to the North section line of Section 24; thence West along the North section line of Section 24. 826.25 feet to the Northeast corner of Section 23; thence south along the East section line of Section 23, 1787.69 feet to the point of beginning proper.

 

TRACT 2 - RESIDENTIAL 2 - Beginning at the Northeast corner of Section 23; thence East along the North section line of Section 23, 224.75 feet to the point of beginning proper; thence East along said section line 1055 feet to the West line of the Northeast Quarter of the Northeast Quarter of Section 23; thence South along said West line 556.50 feet; thence East 627.00 feet; thence North 348.5 feet; thence East 428.00 feet; thence North 208.00 feet to the point of beginning proper.

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
