MINUTES

METROPOLITAN AREA PLANNING COMMISSION

MARCH 16, 1995

 

MEMBERS PRESENT: Coleman, Damron, McCracken, Finley, Beadles, Pitts, and Phillips

 

MEMBERS ABSENT: Little and Shaw

 

Minutes of the February 14, 1995 meeting were approved as submitted.

 

#1  RZ95-11  O. R. McKisson requested approval of rezoning from R-1 to C-3 for 1.34 acres located at 4103 Southwest Drive, on the west side of Southwest Drive, north of Leon Kirksey Road.

 

Mr. McCracken moved to approved subject to a 60' right of way from centerline of Southwest Drive to conform to the MATA plan.  Ms. Finley seconded, 5 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#2  RZ95-12  Linda Smallman requested approval of rezoning from R-1 to R-2 for 2.0 acres located on the west side of Bowling Lane, south of Kitterman Drive.

 

Approximately 10 people were present opposing the zoning change.  It was noted that there are several nonconforming multifamily uses in the area as well as some lots zoned R-2 with multifamily uses.  Much of the land to the east is undeveloped.

 

Mr. McCracken made a motion to approve the request based on the apartment use on the north and the R-2 zoning currently unutilized on the east, and subject to:

 

1.                     Plat being revised to show the right of way on the east boundary line ending at the edge of the right of way

2.                     Full street improvements being made to Bowling Lane, including curb and gutter at the time of development

 

Motion failed for lack of a second.

 

Dr. Beadles moved to deny the request, seconded by Finley. Four voted aye, 1 no, REQUEST DENIED.

 

#3  RZ95-13  Jim Mashburn requested approval of a rezoning from R-1 to R-2 for .71 acre located on the south side of Nettleton Avenue, west of Elmdale Drive.

 

This item was WITHDRAWN.

 

#4  SU95-1  Maxine Bowers requested approval of placement of two mobile homes on separate lots adjacent to 4219 Richardson Road.

 

It was noted that there are many mobile homes in this area including one occupied by Ms. Bowers.  Proper numbers of signatures were submitted.

 

Mr. Pitts moved to approve the request with the following stipulations:

 

1.  Street improvement agreement for Richardson Road

2.  Review and approval of the plat by all appropriate city offices, CWL, Arkla, Southwestern Bell for easements that might be necessary regarding this plat since it was not available until this meeting

 

Ms. Finley seconded with 5 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#5  RZ95-15  Skip Macon requested approval of rezoning from R- 1 to C-3 for 18.58 acres located on the south side of Race Street, east of Fair Park Blvd.

 

Ms. Finley moved to approve the rezoning, seconded by Mr. Pitts.  Five voted aye, 0 no, REQUEST APPROVED.

 

#6  PP95-4  Skip Macon requested preliminary approval of subdivision plans for Macon's Addition containing 5 lots on 18.58 acres.  The property is located on the south side of Race Street, east of Fair Park Blvd.

 

In discussion, the Project Engineer for the development stated the ditch will be relocated and that will decrease the floodway and contain it within the boundaries of the ditch.  The relocation of the ditch actually crosses the property line to adjacent properties and their consent is required for the changes.  It was stated that CEI Engineering was working on the map revisions.  It was further understood that no building permits are to be issued on the lots without the whole street being done.  Mr. Macon only owns property on one side of the road.  He is planning to get the other owners to participate in the street development.

 

Mr. McCracken moved to approve subject to:

1.  Right of way on Race Street being revised to show 50' from centerline in accordance with MATA plan

2.  A review by Staff in regard to Gilmore assuring that it complies with MATA right of way

3.  Engineering comments on FEMA and the ditch realignment

4.  Utility comments on easements

5.  Full compliance with city code on Gilmore street improvements

6.  Existing pavement on Gilmore must connect to new pavement on the south

7.  Street specifications or modifications that were discussed

8.  City approval of the ditch modifications

9.  Easements from ditch being obtained from adjoining property owner

 

Ms. Finley seconded with 6 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#7  PP95-5  Ronnie White requested preliminary approval of subdivision plans for East Park Subdivision containing 63 lots on 17.27 acres.  The property is located on the east side of Richardson Road, north of the Access Road and will be a continuation of Kristal Drive and Curtview Drive.

 

Drainage plans the City Engineer's Office has were discussed. It was also suggested that the developer contact the owner of the property along Allison Street for possibly abandoning the right of way for this street.  Additional accesses were also discussed.

 

Mr. McCracken made a motion to approve subject to:

1.  Revising plat to bring Lot 8 into compliance for minimum lot standards

2.  A statement that Richardson Road dedication is 30' from centerline and the commission feels that is adequate as it dead ends on Race and Access and cannot go further

3.  Engineer's comments on seals and certification

4.  Kristal and Curtview Drives - drainage structures and ditch being revised to coordinate with city plans for improving the ditch

5.  Owner and city work out mutual agreement to assure connection of Kristal and Curtview to existing pavement on north, with developer providing that if nothing else can be worked out

6.  Property owner encouraged to get with north property owner to seek abandonment for half street dedication of Allison, which serves no purpose at this point

7.  Property owner encouraged to look at extending Landsbrook to property line on north for possible connection to adjoining property

8.  15' drainage easement across north property line

9.  Revise plans to reflect Richardson Road with full improvements to a half street or full width paving of 24' with 4' shoulders

10. Drop inlets being substituted for flumes

11. Revised plat to show flood plain

12. Proper radii being shown at all corners

13. Fire Chief comments concerning the connection of the two streets to the north

 

Dr. Beadles seconded with 5 voting aye, 0 no, 1 abstaining, REQUEST APPROVED WITH STIPULATIONS.

 

#8  PP95-3  Hillpoint Development, Inc. requested preliminary approval of subdivision plans for The Briars containing 31 lots on 16 acres.  The property is located on the north side of Windover Road, east of Fernwood Drive.

 

Mr. McCracken moved to approve subject to:

1.  Revisions being made on Sweetbriar in regards to its alignment with Briacliff to eliminate the island and make it to intersect at a 90° angle

2.  Street names to meet Fire Department requirements

3.  Owner's signatures and certifications with acknowledgment that the right of way on Windover at 41' from centerline is adequate

4.  Vertical alignments being shown on final plans

5.  Utility easements in staff report

6.  Change grate design to cross hatch

Mr. Pitts seconded with 6 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#9  MP95-14  Norman Ellison requested approval of a 4 lot minor plat on 3.30 acres.  The property is located on the south side of Southwest Drive 1/2 mile west of Clearview Drive.

 

Mr. McCracken moved to approve with the following stipulations:

1.  Provisions be made to comply with City Water and Light utility access to the property to the south

2.  Access to this lot in conjunction with the CWL request, be obtained possibly by using the gravel drive as part of that lot

3.  Drainage easement on west side

Dr. Beadles seconded with 4 voting aye, 2 voting no, REQUEST APPROVED WITH STIPULATIONS.

 

#10  SP95-4  Norman Ellison requested approval of site plans for development on 4 lots.  Each lot contains a separate building from 1,800 sf to 2,520 sf.  The property is located on the south side of Southwest Drive, 1/2 mile west of Clearview Drive.

 

Mr. McCracken moved to table the site plan due to the fact that it does not comply with city ordinances.  Needs to be re-addressed to show paving and revised to comply with city ordinances.  Ms. Finley seconded with 6 voting aye, 0 no, REQUEST TABLED.

 

#11  RP95-9  Paul Throgmartin requested approval of a replat of Lot 2 of Throgmartin Subdivision.  The property is located on the northwest corner of Prospect Road and Elizabeth Lane.

 

The replat is dividing Lot 2 into 6 lots with 4 on Elizabeth Lane and 2 on Prospect Road.

 

Ms. Finley moved to approve the request, seconded by Mr. McCracken.  Five voted aye, one no, REQUEST APPROVED.

 

#12  MP95-15  Tim Spence requested approval of a one lot minor plat containing 3.247 acres.  The property is located on the west side of Stadium Blvd., south of Fox Road.

 

Ms. Finley moved to approve the request subject to right of way extension and street improvements on Malibu Drive.  Mr. McCracken seconded with 6 voting aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#13  SP95-5  Tim Spence request approval of site plans for a commercial development on the west side of Stadium Blvd., south of Fox Road.

 

Mr. Pitts moved to approve as submitted.  Ms. Finley seconded with two voting aye, four no, motion failed.

 

#13A  Mr. McCracken moved to approve the request subject to:

1.  The chat area to be paved if used as a car sales lot

2.  If not used as a car lot, will be up to staff to determine if it is to be paved

Mr. Damron seconded with 6 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#14  MP95-16  Charles Best requested approval of a one lot minor plat containing 1.99 acres and located on the west side of Friendly Hope Road, 1/4 mile south of Woodsprings Road.

 

The commission expressed concerns over development in this area by the selling off of plots with no overall development plans.  Also, staff should investigate Mr. Parker's plans on land he owns in this area, as far as platting with complete plans addressing drainage, streets, utilities, etc.  Mr. Best is the third owner of this parcel.

 

Mr. McCracken moved to approve subject to:

1.  A 40' centerline being shown on Friendly Hope Road

2.  Street Improvement Agreement on Friendly Hope Road

3.  Revised plans to show a 60' private ingress/egress rather than 60' roadway and utility easement

Ms. Finley seconded with 6 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#15  PP95-2  Kent Arnold requested final approval of Key Place Commercial, a subdivision containing 11 lots on 7.12 acres. The property is located on the south side of Johnson Avenue, on the east and west sides of Murray Creek Drive.

 

Revised plans were submitted at the meeting that addressed most of the comments in the staff report concerning some parking areas adjacent to the street, utility easements, proper signatures, drainage easements, etc.  It was noted that the City Council approved the rezoning with the stipulation that a site plan be submitted and approved by the MAPC prior to development on the lots.

 

Ms. Finley made a motion to approve subject to the bill of assurance and deed restrictions being revised to reflect that entrances to the lots can only be as shown on the final plat.  It was further stipulated that the easement document be filed giving easement rights to each of the lot owners.  As drawn several lots will use adjoining property for access to their property from Johnson Avenue.  The motion was seconded by Mr. Pitts.  With 6 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.
