Minutes for the City Council meeting on April 15, 1996

Public hearing 5:00 p.m.

 

The public hearing was called to order by Mayor Brodell at 5:00 p.m. a full quorum was in attendance. Present were Mayor Brodell, Philip Crego, City Attorney and Bryan Wadley for City Clerk Donna Jackson who was ill. 10 council members were present for public hearing including: Hannah, Province, Evans, Wise, Vance, Harpole, Roddy, Perrin, Kelton, Rega.

 

Mr. Ralph Waddell spoke first for the Fair Board requesting rezoning. Mr. Waddell stated that it appeared that the outcome had already been decided. According to newspaper, seven to eight have stated before the hearing how they will vote.

 

He felt that C-3 Zoning is inevitable on a four lane, soon to be Five Lane Road. Hwy. 49 North, making this site the best site for the fair. The question has now been raised by council on whether or not the fair can even locate in C-3 Zoning.

 

The Fair Board is all volunteer; the board is made up of Jaycees and Farm Bureau. Most uses are not charged for. Practically all are for non-profit groups, it is used approximately one third of the year. Fairs throughout the state are located in residential neighborhoods in Clay, Greene, Lawrence, Sebastian, and State Fairgrounds are just to name a few. Fourteen sites were submitted. Traffic can be handled according to Ernie Peters. All are Zoned R-1, some not for sale, some property owners did not know the property had been submitted.

 

3 ALTERNATIVES WERE DISCUSSED:

1. To stay where they are presently

2. To find another site meeting the criteria

3. To dissolve the Fair Association, withdraw Jaycees, withdraw Farm Bureau and let some other association have the fair.

 

The land was not zoned when Wheeler Heights purchased lots so there was not any R-1 Zoning in place prior to the 1989 annexation.

 

Mr. Curt Huckaby spoke for the unfair group at 5:24 p.m.

 

Several documents were submitted for the record. Mr. Huckaby stated the board knew there were zoning problems prior to purchase acknowledged by title opinion from the Fair Board attorney.

 

Attorney General's opinion stated you could not have fairgrounds with so much commercial activity in R-1. Traffic, dust, lights, noise, insects, currently would be increased with larger fairgrounds on it. MAPC vote was six against, one in favor, 1 abstained. 4-9-96 Jaycees voted to withdraw their support of the APPEAL AND THE REZONING. Jaycees voted 3-1 to stop. Farm bureau voted 4-0 to go forward.

 

SURROUNDING AREA. Over 100 homes were built since the fairgrounds purchased the property. 500 homes in a half mile radius of the site. Said this doesn't fit into C-3. Fair Board's attitude--video tape showing by Roger Lee.

 

CITY COUNCIL MINUTES, APRIL 15, 1996

 

The Jonesboro City Council met Monday, April 15, 1996, at 6:30 P.M. A full quorum was in attendance. Present were: Bryan Wadley for Donna Jackson, City Clerk, Philip Crego, City Attorney, and 12 Council Members.

 

The Minutes of April 1, 1996, were approved as mailed by Councilman Perrin and Vance. A voice vote was taken resulting in all Council Members voting aye. Those members voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Roddy, and Harpole.

 

ITEM 4 A.

Councilman Harpole offered the following ordinance for the first reading:

 

AN ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-2) TO COMMERCIAL (C-3), LOCATED ON THE NORTHEAST CORNER OF STADIUM BLVD. AND BASWELL STREET. (DOUG ALLEN)

 

Councilman Harpole moved, seconded by Councilman Wise to suspend the rules and place on second reading. A voice vote was taken resulting in all Council Members voting aye. Those members voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, Harpole. The Ordinance was read twice.

 

ITEM 4B.

Councilman Tate offered the following Ordinance for the first reading.

 

AN ORDINANCE TO REZONE 73.07 ACRES FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-3), LOCATED ON THE SOUTH SIDE OF JOHNSON AVENUE, EAST OF MURRAY CREEK DRIVE AND WEST OF POMONA DRIVE. (CRAIGHEAD COUNTY FAIR ASSOCIATION, INC.)

 

Councilman Tate moved, seconded by Councilman Harpole to suspend the rules and place on the second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. *Councilman Tate moved, seconded by Councilman Roddy to suspend the rules and place on the third reading. The vote was aye, 9-3. Those voting aye were: Wise, Evans, Province, Hannah, Young, Tate, Kelton, Roddy, and Perrin. Nay: Vance, Rega, and Harpole. Councilman Evans, seconded by Councilman Tate moved for adoption of the ordinance. Those members voting aye were: Vance and Harpole. Voting Nay P.2 Were: Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin. The Ordinance was disapproved by a vote of 10-2.

 

Mr. Waddell objected to the third reading and wanted the Council to review the item further. Mr. Huckaby wanted a decision tonight because of the attendance. Three opinions were asked of the City Attorney. Mr. Harpole asked and the attorney said this was not spot zoning. Mr. Young asked if it did not fit in C-3 Zoning. And Mr. Vance asked is the vote tonight not for the fair location, but for zoning, are we voting for the fair or for zoning.

 

ITEM 4 (C).

Councilman Kelton offered the following Ordinance for the first reading:

 

AN ORDINANCE TO REZONG 12 ACRES FROM AGRICULTURAL (AG-1) TO RESIDENTIAL (R-1), LOCATED ON THE EAST SIDE OF PARAGOULD DRIVE, NORTH OF SHAGBARK LANE. (GENE BARNETT)

 

Councilman Tate moved, seconded by Councilman Perrin to suspend the rules and place the item on second reading. A voice vote was taken resulting in all Council Members voting aye. Those members voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The Ordinance was read twice.

 

ITEM 4 (D).

Councilman Rega offered the following Ordinance for 1st reading:

 

AN ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-1) TO RESIDENTIAL (R-2), LOCATED ON THE SOUTH SIDE OF WILKINS AVENUE, WEST OF METZLER LANE. (ST. BERNARD'S FOUNDATION)

 

Councilman Vance moved, seconded by Councilman Young to suspend the rules and place on the second reading. A voice vote was taken resulting in all Council Members voting aye. Those members voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Mr. Bruce Burrow spoke in favor of zoning and the project. Also, that he is pleased to see that it is proposed by St. Bernard's. The Ordinance was read twice.

 

ITEM 4 (E).

Councilman Vance offered the following Ordinance for 1st reading:

 

AN ORDINANCE TO AMEND SECTION 15.12.03, SUBSECTION (b) CHANGING THE MINIMUM LOT SIZE FOR RESIDENTIAL DESIGN FROM SIXTY FEET TO FIFTY FEET.

 

DISCUSSION: Does not affect square footage.

 

Councilman Vance moved, seconded by Councilman Young to suspend the rules and place on the second reading. A voice vote was taken resulting in all Council Members voting aye. Those members voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The Ordinance was read twice.

 

ITEM NO. 5.

A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY OF JONESBORO, ARKANSAS TO UTILIZE FEDERAL-AID SURFACE TRANSPORTATION PROGRAM ENHANCEMENT FUNDS FOR SIGNALIZATION AT THE INTERSECTION OF STATE HIGHWAY 18 (HIGHLAND DRIVE) AND BITTLE STREET/FAIRPARK BOULEVARD.

 

Councilman Evans moved, seconded by Councilman Vance to adopt the resolution. City Council understands Federal Aid Surface Transportation Enhancement Funds are available at 50% Federal Participation and 50% local cash match. Also provide any needed Right Of Way. (who) AHTD recommended after their study that it meets their criteria. All voted aye for adoption. Those members voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

Mr. Tate asked for a study at Patrick and Johnson. Mayor Brodell said that he would ask. He will also discuss Stadium and Race at the next Council Meeting.

 

ITEM NO. 6.

Councilman Vance offered the following Ordinance for first reading:

 

AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE REPAIRS TO THE CITY OF JONESBORO'S CATERPILLAR LOADER J.A. RIGGS TRACTOR CO. OF JONESBORO AT A COST OF $13,450.00 966C CATERPILLAR LOADER REPAIR, JONESBORO STREET DEPT.

 

Councilman Vance moved, seconded by Councilman Kelton to suspend the rules and place on the second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Perrin moved, and Councilman Young moved to further suspend the rules and place on third and final reading. All voted aye. Those voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Young, seconded by Councilman Vance, moved to adopt the Ordinance. All voted aye. The Ordinance was adopted and given the number 2694.

 

Under new business, Maurice Bell of Forrest Street requested a building permit extension to 90 days. Councilman Vance moved, Seconded by Councilman Tate to adopt a resolution approving the request. All voted aye. There was no resolution though it was referred to as one. Those voting aye were: Vance, Wise, Evans, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The resolution was given the number 1996:11.

 

Mayor Hubert Brodell announced a public hearing on the land use map and plan on 4-28-96 with the MAPC at 5:30 p.m. at city hall.
