AN ORDINANCE CALLING A SPECIAL ELECTION TO VOTE UPON THE QUESTION OF LEVYING A MUNICIPAL MOTOR VEHICLE TAX FOR THE YEAR 1975, UNDER AUTHORITY OF ACT 446 OF 1965 AS AMENDED

WHEREAS, the City of Jonesboro, Arkansas is required to provide and maintain streets of the city and find the additional cost of labor and materials necessitate additional revenues; and

 

WHEREAS, the purpose of this Ordinance is to submit to the electors of the City at a special election called for that purpose the question of authorizing the Levying a Municipal Motor Vehicle Tax for the year 1975 under authority of Act 446 of 1965 as amended;

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: That a special election is, and the same is hereby called to be held in the City on September 3, 1974, at which election there will be submitted to the electors of the City the question of levying a Municipal Motor Vehicle Tax for the year 1975 under authority of Act 446 of 1965 as amended.

 

Section 2: That the question shall be placed on the ballot for the election in substantially the following form:

 

Vote on measure by placing an “X” in the square above measure either FOR or AGAINST:

 

FOR the levying a Municipal Motor Vehicle Tax for the year 1975 under authority of Act 446 of 1965 as amended…………………………………….□

 

AGAINST the levying  a Municipal Motor Vehicle Tax for the year 1975 under authority of Act 446 of 1965 as amended…………………………………….□

 

It is proposed by resolution of the City Council of the City of Jonesboro, Arkansas (“CITY”) that the City levy a Municipal Motor Vehicle Tax for the year 1975 upon the owners of al motor vehicles within the corporate limits of the City of Jonesboro, Arkansas, for the privilege of using and operating said motor vehicles upon the public roads, streets, and other public ways of the City, but that the tax become effective only in the event that the Craighead County Quorum Court by the time of the adjournment of its regular annual session for the year 1974 fails to levy a vehicle tax upon owners residing within the City of Jonesboro; and provided further, that in the event that the Quorum Court does levy a vehicle tax effective for the year 1975 upon residents of this City, and such levy is subsequently approved by the County Electors but does not levy the full amount of the authorized tax, then in that event, the tax levied hereunder shall be the difference between the amount so levied by the County Quorum Court and the maximum tax per vehicle ($5.00). The maximum amount of such tax of such motor vehicles shall be $5.00 per year for all motor vehicles with four (4) or more wheels (including but not limited to automobiles, busses, trucks, taxicabs, ambulances, etc.;) $2.00 per year for all motor vehicles with three (3) or less wheels (including but not limited to motorcycles, motor scooters, motor bikes, etc.) Providing further that failure to pay city vehicle tax shall be a misdemeanor and punishable by fine upon conviction and that, revenues from said tax shall be used for street and parks of the City.

 

Section 3: That the election shall be held and conducted and the vote canvassed and the results declared under the law and in the manner provided for municipal elections, so far as the same may be applicable, and the Mayor of the City shall give notice of such election by an advertisement published once a week for two consecutive weeks in a newspaper having a bon-a-fide circulation in the City, with the last publication to be not less than ten (10) days prior to the date of the election, and only qualified electors of the City shall have the right to vote at the election on the question.

 

Section 4: That the results of the election shall be proclaimed by the Mayor and his proclamation shall be published one time in a newspaper having a bon-a-fide circulation in the City, which proclamation shall advise that the results as proclaimed shall be conclusive unless attacked in the courts within thirty days after the date of such proclamation.

 

Section 5: That, a copy of this Ordinance shall be furnished to the Craighead County Board of Election Commissioners so that the necessary election officials and supplies may be provided.

 

Section 6: That there is hereby found and declared to be an immediate need for the securing additional revenues for street and park purposes and the levying of the tax referred to in this Ordinance is essential to accomplishing the said public benefits. It is, therefore, declared that an emergency exists and this Ordinance being necessary for the immediate preservation of the public health, safety and welfare shall be in force and take effect immediately upon and after its passage.
