AN ORDINANCE  GIVING NOTICE OF REVISIONS TO TITLE 15 OF THE JONESBORO MUNICIPAL CODE OF THE CITY OF JONESBORO, ARKANSAS

WHEREAS, Title 15 of the Jonesboro Municipal Code regulates the subdivision of property in the City of Jonesboro,
 
WHEREAS, Section 15.20.02, of the Jonesboro Municipal Code, states:
 
No building permit shall be issued nor shall any utility line or service be extended to serve any structure and no person shall sell or offer any lot or part of any subdivision for sale nor construct any building unless:
 
A.      The lot, building or structure was established before September 19, 1955.
 
B.      All requirements of this chapter and regulations hereunder have been done. (Ord. No. 909, Sec. VI, 9-19-55.)
 
WHEREAS, Section 15.16.02, of the Jonesboro Municipal Code, requires evidence that an appropriate funded escrow agreement in the amount of the contract cost of street improvements exist and is in full force.
 
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
 
SECTION 1.  That the following paragraph be added to Section 15.20.02:
 
Notice is hereby given to all current and future Developers in the City of Jonesboro that failure to provide an appropriate funded escrow agreement or any default on that agreement shall result in the withholding of any new residential building permits within the specific Development.  Written notification of such failure or default shall be given by the City Attorney to the Developer and a copy of that notification filed at the Craighead County Courthouse as Public Notice.
 
SECTION 2.  That all Ordinance and parts of Ordinances in conflict herewith are hereby repealed to the extent of said conflict.
 
SECTION 3.  Further, there exists an immediate need to implement the bonding requirements to ensure the financial continuity, safety and welfare of the City of Jonesboro and its citizens.  Therefore, an emergency is declared to exist, and this Ordinance shall take effect immediately upon passage and approval.
