AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND APPROVE THE PURCHASE OF REPAIR SERVICES FOR THE EARL BELL COMMUNITY CENTER, AND DECLARING AN EMERGENCY

WHEREAS, the precast concrete pieces on the front entrance of the Earl Bell Community Center are in need of immediate repair because they have deteriorated to the point of allowing water leakage into the building and are in danger of falling onto visitors; and
WHEREAS, the repairs are estimated at $80,000, and shall not exceed $100,000 due to contingencies.
NOW THEREFORE BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:
SECTION ONE: That the City Council in accordance with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding deeming it unfeasible to bid due to the immediate nature of the problem. The City Council directs the Purchasing Agent to purchase the above described services based on the estimate received.
SECTION TWO: It is further found that due to the immediate need for repairs to the entrance and preserve the safety of visitors at the Earl Bell Community Center, an emergency is declared to exist and this ordinance being necessary to keep up maintenance on right of ways and for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.
