AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF LAW ENFORCEMENT RIFLES FOR THE POLICE DEPARTMENT

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:
SECTION ONE: That the Police Department of the City of Jonesboro, Arkansas needs to update and purchase sixteen (16) FN SCAR 5.56 caliber law enforcement rifles and sixteen (16) 10 inch barrels for said rifles.
SECTION TWO: That said equipment is of limited supply and is currently only available for purchase from TK Tactical, the only current source provider, for the sum of $ 39,968.00, with freight and sales tax included.
SECTION THREE: That the City Council in accord with the terms of A.C.A. Section 14-58-303 hereby waives the requirement of competitive bidding since the purchase is an only source and directs the Purchasing Agent to purchase the above described for the price set forth in Section 2 above.
SECTION FOUR: It is further found that due the limited availability and that the items are being held for this agency by TK Tactical for a period of 30 days pending approval of this purchase, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.
